dc.description.abstractMonografia „Polityka ustawodawcza rzymskich cesarzy chrześcijańskich w sprawach religijnych” skupia się na zagadnieniach wzajemnych relacji pomiędzy państwem i Kościołem w Imperium Rzymskim w okresie IV-VI w. Praca składa się z pięciu rozdziałów. W pierwszym zostało omówione ustawodawstwo religijne rzymskich cesarzy chrześcijańskich (począwszy od Konstantyna Wielkiego do Justyniana I) w kontekście ustawodawstwa okresu późnego cesarstwa (dominat). W poszczególnych paragrafach zostały przedstawione stosunkowo obfite i rozwlekle co do stylu ustawy religijne zawarte w zbiorach: Codex Theodosianus, Novellae Posttheodosianae, Constitutiones Sirmondianae, Codex Iustinianus i Novellae Iustiniani. Dalsza konstrukcja pracy bazuje na systematyce przyjętej przez redaktorów szesnastej księgi Kodeksu Teodozjańskiego i pierwszej Kodeksu Justyniana. I tak, przedmiotem drugiego rozdziału jest ustawodawstwo przeciwko przestępstwu herezji, w tym także przeciwko Manichejczykom. Ustawy ogłoszone przez cesarzy rzymskich przeciwko odstępcom od wiary chrześcijańskiej (apostatom) są przedmiotem analizy w trzecim rozdziale. Rozdział czwarty obejmuje omówienie ustawowych ograniczeń kar wydanych przeciwko poganom, wyznawcom starej (politeistycznej) religii rzymskiej. Ustawodawstwo karne ogłoszone przeciwko żydom stanowi treść piątego, ostatniego rozdziału. Praca omawia ustawodawstwo tylko w aspekcie normatywnym, zasadniczo nie zajmując się ich aplikacją; obok analizy prawnokarnej zawartości wspomnianych aktów prawnych, dokonane zostało porównanie ich ze sobą.pl
dc.description.abstractThe monograph work, Polityka ustawodawcza rzymskich cesarzy chrześcijańskich w sprawach religijnych [Legislative Policy of the Roman Christian Emperors in Matters of Religion], addresses the State-Church relationships in the Roman Empire from the 4th through the 6th century. The work contains five chapters. Chapter One covers the religious legislation of the Roman Christian emperors (from Constantine the Great to Justinian I) against the backdrop of the general legislation of the late imperial period (the Dominate). The chapter explores the religious laws contained in the collections of Codex Theodosianus, Novellae Posttheodosianae, Constitutiones Sirmondianae, Codex Iustinianus and Novellae Iustiniani, which are relatively abundant and lavish in terms of the stylistic measures used. The further structure of the work mirrors the systematic approach adopted by the editors of Book XVI of the Codex Theodosianus and Book I of the Codex Iustinianus. Consequently, the subject of Chapter Two is legislation against the crime of heresy, including the case of Manichaeism. Chapter Three considers the laws enacted by the Roman emperors against those who deviated from the Christian faith (apostates). Chapter Four discusses the statutory limitations of punishments imposed on heathens, i.e. adherents to the old (polytheistic) Roman religion. Finally, penal legislation intended against Jews is expounded in the last chapter. The work focuses on the Roman legislation only in its normative aspect and, essentially, omits to discuss its practical application. In addition to the analysis of the mentioned laws in terms of effects under penal law, the author also offered some comparative insights.pl
