Abstract
Praca skupia się na próbie zrozumienia mens papieża Franciszka w odniesieniu do okresu po rozpadzie małżeństwa, co może skutkować wytoczeniem pozwu o ważność małżeństwa przed sądem kościelnym lub wykorzystaniem innego rozwiązania kanonicznego. Punktem wyjścia rozprawy są Synody Biskupie o Rodzinie w 2014 i 2015 roku oraz reforma małżeńskiego procesu kanonicznego, która wyrosła z pierwszego z tych synodów. Nauczanie papieża Franciszka dotyczące małżeństwa i rodziny jest najpierw osadzone w kontekście wcześniejszego Magisterium Kościoła, następnie omawiane są treść i wkład synodów biskupich oraz reforma małżeńskiego procesu kanonicznego. Wreszcie praca dotyczy usług konsultacyjnych i poradnictwa w Kościele, a także deontologii konsultantów; przedstawia możliwości kanonicznych rozwiązań odnośnie rozbitych małżeństw i kulminuje w zastosowaniu wymogu „postępowania przedsądowego i duszpasterskiego” na terenie diecezji brneńskiej oraz skonkretyzowanej propozycji utworzenia lokalnego Vademecum poradnictwa dla małżonków w kryzysie, dla rozwiedzionych i żyjących w nowych związkach niesakramentalnych.
This dissertation focuses on the understanding of Pope Francis' mens regarding the period following the breakup of a marriage, which may result in bringing proceedings for the validity of the marriage before an ecclesiastical court or under another canonical solution. The starting points of the dissertation are the Synods of Bishops about the family in 2014 and 2015 and the reform of the matrimonial canonical process, which arose from the first of these synods. Pope Francis' teachings of marriage and the family is at first set in the context of the previous Catholic doctrine, then the content and contribution of the Synods of Bishops and the reform of the matrimonial canonical process are discussed. Subsequently, the dissertation deals with consulting and advisory services in the Church, as well as the deontology of consultants. The author presents possibilities of a canonical solution of failed marriages and the treatise culminates in the application of the requirement of the “pre-judicial or pastoral inquiry” for the territory of the diocese of Brno and a specified proposal for the creation of a local Vademecum of consulting services for spouses in crisis, divorced and remarried.
