Zadania samorządu terytorialnego w ochronie zdrowia osób starszych

Abstract

Przedmiotem rozprawy doktorskiej jest problematyka zadań samorządu terytorialnego w zakresie ochrony zdrowia osób starszych. Głównym celem rozprawy była kompleksowa analiza przepisów prawnych dotyczących omawianej tematyki. Badania naukowe zostały poszerzone o cele szczegółowe. Pierwszym celem szczegółowym była próba ustalenia rozumienia pojęcia osób starszych i dookreślenia miejsca tej grupy społecznej w systemie samorządowego modelu ochrony zdrowia. Drugim ustalenie prawnych granic regulujących zadania administracji publicznej w zakresie ochrony zdrowia starszych. trzecim celem szczegółowym jest próba usystematyzowania zadań jednostek samorządu terytorialnego z obszaru ochrony zdrowia osób starszych w zakresie organizacyjnym i finansowym. Czwartym celem szczegółowym zaś analiza prawnych form działania administracji samorządowej w obszarze wsparcia osób starszych. teza pracy stanowi, że obowiązujące przepisy prawne nie zapewniają odpowiednich instrumentów prawnych niezbędnych do prawidłowej realizacji zadań z zakresu ochrony zdrowia osób starszych przez jednostki samorządu terytorialnego. Za przedstawioną tezą badawczą można wyodrębnić tezy pomocnicze: jedyny akt prawny wprost skierowany do osób starszych, nie reguluje zadań wykonywanych w tym zakresie przez jednostki samorządu terytorialnego; jednostki samorządu terytorialnego nie posiadają obligatoryjnego obowiązku podejmowania działań w obszarze polityki senioralnej. Praca składa się z wykazu skrótów, wstępu, 4. rozdziałów, zakończenia i bibliografii.The subject of his doctoral dissertation is the issue of the tasks of local government in the field of health care for the elderly. The main objective of the thesis is a comprehensive analysis of the legal provisions relating to the subject in question. Research is expanded to include specific objectives. The first of the specific objectives presented is an attempt to determine the concept of elderly and to define the place of this social group in the system of the local government model of health care. The second specific objective is to establish the legal boundaries regulating the tasks of public administration in the field of health care of the elderly. The third specific objective is to analyze the legal forms of activity of local government administration in the area of support for the elderly. The thesis of the study states that the applicable legal instruments necessary for the proper implementation of tasks in the field of health care of the elderly by local government units. Additional supporting theses can be extracted: the only legal act directly addressed to the elderly does not regulate the tasks performed in this area by local government units; local government units do not have an obligatory responsibility to take action in the area of senior policy.
