Akty prawa miejscowego organów samorządu terytorialnego w działalności Rzecznika Praw Obywatelskich

Abstract

Przedmiotem rozprawy doktorskiej jest problematyka aktów prawa miejscowego stanowionych przez organy samorządu terytorialnego oraz przedstawienie uprawnień i podejmowanych działań w tym zakresie przez Rzecznika Praw Obywatelskich. Rozprawa składa się z pięciu rozdziałów. W rozdziale pierwszym zostały zaprezentowane zagadnienia podstawowe związane z instytucją Rzecznika Praw Obywatelskich. W rozdziale drugim rozprawy przedstawione zostały rozwiązania prawne przyjęte w wybranych krajach. Rozdział trzeci jest próbą określenia miejsca Rzecznika Praw Obywatelskich w działalności samorządu terytorialnego. Rozdział czwarty ma na celu omówienie uprawnień Rzecznika Praw Obywatelskich w kontekście źródeł prawa powszechnie obowiązującego, w tym w zakresie stanowienia aktów prawa miejscowego przez organy samorządu terytorialnego. W rozdziale piątym, przeanalizowałem wystąpienia generalne i indywidualne Rzecznika w przedmiotowym zakresie. Analiza ta, uzupełniona została o orzecznictwo sądów administracyjnych, Sądu Najwyższego oraz Trybunału Konstytucyjnego. Wynikiem rozważań niniejszej rozprawy jest analiza i ocena rozwiązań przyjętych przez polskiego ustawodawcę. Ponadto rezultatem przedmiotowych badań jest także sformułowanie względem polskiego ustawodawcy postulatów de lege ferenda w celu wskazania proponowanych kierunków zmian.The subject of the discussed doctoral dissertation is a problem of local legal acts enacted by local government bodies as well as presentation of the powers and actions taken in this respect by the Human Rights Defender. The dissertation consists of five chapters. The first chapter presents the basic issues related to the institution of the Human Rights Defender. The second chapter of the dissertation presents legal solutions adopted in selected European Union countries and in Great Britain. Chapter three is an attempt to define the position of the Human Rights Defender in the activities of local government. The fourth chapter aims to discuss the rights of the Human Rights Defender in the context of the sources of generally applicable law, including the enactment of local law by local government bodies. In chapter five, I analyze the Ombudsman's general and individual speeches in this respect. The result of the considerations in this dissertation is the analysis and evaluation of the solutions adopted by the Polish legislator. Moreover, the result of the research in question is also the formulation of de lege ferenda postulates towards the Polish legislator in order to indicate the proposed directions of changes.
