dc.description.abstractOrganizacja i odbywanie się zgromadzeń jest przejawem realizacji wolności zgromadzeń. Celem tego opracowania jest przedstawienie roli, jaką pełnią administracyjnoprawne regulacje dotyczące organizacji zgromadzeń i ich związku z szeroko rozumianym bezpieczeństwem. Rozwiązaniu zakreślonego problemu badawczego służyło wykorzystanie następujących metod badawczych: metody logiczno-językowej, historycznej, komparatystycznej, aksjologicznej i hermeneutyki prawniczej. Wynik przeprowadzonych w tej dysertacji badań pozytywnie zweryfikował poprawność postawionych w jej wstępie tez: 1. administracyjnoprawne procedury organizacji zgromadzeń służą zapewnieniu ich bezpieczeństwa, a nie ograniczeniu realizacji wolności do zgromadzania się, 2. każde zgromadzenie stwarza zagrożenie dla bezpieczeństwa i porządku publicznego, ale niekoniecznie musi je naruszać, 3. zaniechanie ustawowego określenia granic wolności zgromadzeń utrudnia zapewnienie bezpieczeństwa i porządku publicznego w jego trakcie. Ogranicza także respektowanie innych praw i wolności obywatelskich. Zbiorcza ocena obowiązujących regulacji prawnych, przedstawione rozwiązania niedoskonałości i kontrowersyjności powodowanych przez przyjęte uregulowania normatywne, mogą przyczynić się do ciągłego doskonalenia przestrzeni prawnej, właściwej interpretacji przepisów konkretyzujących korzystanie z wolności zgromadzeń jak również doprowadzić do nowego otwarcia w dyskusji o kształcie administracyjnoprawnej reglamentacji zgromadzeń.pl
dc.description.abstractThe organization and performance of assemblies is the manifestation of the implementation of freedom of assembly. The purpose of this dissertation is to present the role of administrative law regulations regarding the organization of associations and their relationship with broadly understood security. The solution to the defined research problem was found by using the following research methods: the logical-linguistic method, the historical method, the comparative method, the axiological method and he hermeneutics of law. The result of the research carried out in this dissertation positively verified the correctness of the theses proposed in its introduction: 1. the administrative-legal procedures of the organization of assemblies serve to ensure their safety, and not to limit the implementation of freedom of assembly, 2. each assembly poses a threat to public safety and order but does not necessarily violate it, 3. abandoning the statutory definition of the limits of freedom of assembly makes it difficult to ensure security and public order during it. It also limits respect for other civil rights and freedoms. Collective assessment of applicable legal regulations, presented solutions to imperfection and controversiality caused by the adopted normative regulations, may contribute to the continuous improvement of the legal space, the correct interpretation of the provisions specifying the exercise of the freedom of assembly, as well as lead to a new opening in the discussion on the shape of administrative regulation of assemblies.pl
