Zasada zaufania do stron procesowych w kanonicznych sprawach o nieważność małżeństwa

Abstract

Cel rozprawy stanowi analiza i interpretacja zmian w procesie o nieważność małżeństwa oraz ich ocena w kontekście zaufania do stron procesowych. Postawiono w niej pytanie: czy w aktualnym stanie prawnym, tj. po reformie procesu małżeńskiego z 2015 r., można już mówić o zaufaniu do stron procesowych jako jednej z zasad obowiązujących w interpretacji i aplikacji przepisów przewidzianych dla prowadzenia tych spraw? Problematyka została opracowana w dwóch zasadniczych częściach, które podzielono na rozdziały rozbudowane na mniejsze jednostki tematyczne. Całość została poprzedzona spisem treści, wstępem oraz wykazem skrótów. Pierwsza część monografii – w ramach sześciu rozdziałów – zawiera wyjaśnienie podstawowych pojęć, takich jak: termin strona oraz jego zakres znaczeniowy; strona powodowa; strona pozwana; rzecznik sprawiedliwości i obrońca węzła małżeńskiego; pełnomocnik i adwokat; zaufanie oraz ramy prawne dla jego okazania. Część druga podzielona została na pięć rozdziałów. Zawiera analizę i ocenę kluczowych zmian w procesie o nieważność małżeństwa odnoszących się do stron procesowych. Dotyczą one: prawa do zaskarżenia małżeństwa; właściwości sądowej; oświadczeń stron; apelacji; ustanowienia tzw. procesu skróconego przed biskupem. Zakończenie jest reasumpcją przeprowadzonych analiz i próbą odpowiedzi na główne i szczegółowe pytania badawcze. Rozprawa zawiera też wykaz bibliograficzny źródeł i opracowań oraz streszczenie w języku angielskim.

The aim of the dissertation is to analyse and interpret changes in the process for declaring matrimonial nullity and to evaluate them in the context of trust in the parties to the proceedings. The question is posed: in the current legal situation, i.e. after the 2015 reform of the marriage process, is it already possible to speak of trust towards parties to proceedings as one of the principles in the interpretation and application of the regulations provided for the conduct of these cases? The issues raised are developed in two main parts, which have been divided into chapters expanded into smaller thematic units. This is preceded by a table of contents, an introduction and a list of abbreviations. The first part of the monograph — in six chapters — contains an explanation of basic concepts, such as: the term “party” and its meaning range; petitioner; respondent; promoter of justice and defender of the marriage bond; procurator and advocate; “trust” and the legal framework for demonstrating it. The second part — in five chapters — contains an analysis and assessment of key changes in the matrimonial nullity process relating to parties to proceedings. They concern: the right to challenge a marriage; forum of competent jurisdiction; statements of the parties; appeal; establishing the so-called “briefer process” before the bishop. In conclusion, there is a reassumption of the analysis carried out and an attempt to answer the main question and detailed research questions. The dissertation also includes a bibliographic list of sources and studies, as well as an abstract in English.
