Iniuria w kanonicznym prawie karnym

Abstract

Ojcowie Soboru Watykańskiego II napisali, że należy udostępnić człowiekowi to wszystko, czego potrzebuje do prowadzenia życia prawdziwie ludzkiego, jak np. prawo do dobrej sławy i szacunku. Troska wspólnoty o dobre imię, godność osobistą i nienaruszalność cielesną wyraża się m.in. w normach prawa karnego. Prawodawca kościelny, który chciał zagwarantować należne każdemu poszanowanie, wyszczególnił szereg przestępstw przeciwko temu. W monografii zaprezentowano ewolucję iniuria w prawie rzymskim oraz te jej elementy, które zostały przejęte przez prawo Kościoła katolickiego. Wskazano przestępstwa oraz przykłady przepisów prawnych zawierających elementy omawianego deliktu w historii Kościoła. Ukazano kwestię bona fama w obowiązującym prawie kanonicznym. Podjęto analizę pod kątem zniewagi wszystkich przepisów oraz innych nadużyć, o których w prawodawstwie Kościoła. Podjęto się analizy przestępstw stanowiących bezpośrednie korelaty rzymskiej iniuria. Przedstawiano fałszywe doniesienia na spowiednika dotyczące przestępstwu przeciwko szóstemu przykazaniu Dekalogu, składanie nieprawdziwych doniesień o innych deliktach oraz zniesławienie bona fama. Opisano również procesową ochronę przed iniuria w prawie karnym Kościoła.

The Fathers of the Second Vatican Council wrote that there must be made available to all men everything necessary for leading a truly human life, such as for example the right to a good reputation and to respect. The community's concern for a good name, personal dignity and bodily inviolability is expressed, among others, in the rules of penal law. The Church legislator specified a number of crimes against this. The monograph presents the evolution of iniuria in Roman law and its elements, which were incorporated by the law of the Catholic Church. Crimes which are kind of equivalent of the Roman iniuria in current canon law are indicated in the dissertation. Canonical understanding of crime and examples of legal regulations containing elements of the discussed delict in the history of the Church are given there. It presents the issue of bona fama in current canon law. An analysis was also mad of all crimes and other abuses that are treated in the Church's legislation as to the insult aspect. The dissertation deals with the analysis of crimes which are the direct correlates of Roman iniuria. A false confessor's denuntiation regarding a crime against the sixth commandment of the Decalogue, false reports about delicts and defamation of the bona fama have been described. The court protection against iniuria in the penal law of the Church has been circumscribed.
