Normatywny model nauczania żołnierzy w czynnej służbie wojskowej

Abstract

Temat rozprawy odnosi się do nauczania żołnierzy w czynnej służbie wojskowej. Przedmiotem analizy uczyniono wybrane, powszechnie obowiązujące źródła prawa krajowego, akty wewnętrzne uczelni wojskowych, dorobek doktrynalny i orzecznictwo. Problem badawczy postawiono w formie pytania o to, czy obowiązujące regulacje są funkcjonalne, a tym samym wystarczające i dostosowane do aktualnych i dających się przewidzieć potrzeb Sił Zbrojnych RP. Dysertację podzielono na pięć rozdziałów. Punktem wyjścia są podstawowe założenia językowe oraz refleksja nad naturą stosunku służbowego, miejscem prawa wojskowego w polskim systemie prawnym oraz wyzwaniami szkolnictwa wojskowego. W drugim rozdziale zawarto analizę historyczno–prawną przeobrażeń szkolnictwa wojskowego od odzyskania niepodległości w 1918 r. do transformacji ustrojowej w 1989 r. Kolejne rozdziały mają charakter analityczno–syntetyczny. W trzecim rozdziale scharakteryzowano ustrój współczesnego szkolnictwa wojskowego. Czwarty rozdział poświęcono rozważaniom nad rozwiązaniami normatywnymi służącymi nauczaniu żołnierzy w służbie kandydackiej i zawodowej. Piąty rozdział pracy odnosi się do szkolenia żołnierzy w ramach pozostałych form czynnej służby wojskowej. Praca uwzględnia stan prawny na 5 października 2020 r.The subject of the dissertation refers to the education of soldiers in active military service. The author focused mainly on: universally binding national law, internal acts of military academies, doctrinal achievements and jurisprudence. The research problem was posed in the form of a question whether the applicable regulations are functional, and thus adapted to the needs of the Polish Armed Forces. The dissertation is divided into 5 chapters. The starting point is basic language assumptions and reflection on the nature of the service relationship, the place of military law in the Polish legal system and the challenges of military education. The second chapter contains a historical and legal analysis of the transformations of military education from regaining independence in 1918 to the transformation of the political system in 1989. The following chapters are analytical and synthetic. In the third chapter the Author describes the modern system of military education. The fourth chapter is devoted to considerations on normative solutions for teaching soldiers in the candidate and professional service. The fifth chapter refers to the training of soldiers in the framework of other than aforementioned forms of active military service. The dissertation takes into account the legal status as of the 5 October 2020.
