Zastosowanie koncepcji "moral panic" w badaniu procesu stanowienia prawa

Abstract

Praca poświęcona jest problematyce paniki moralnej w obszarze stanowienia prawa. Wyjaśnia ona, czym jest panika moralna oraz wskazuje etapy rozwoju niepokoju społecznego w powiązaniu z procesem stanowienia prawa, oraz identyfikacją podmiotów, które podejmują decyzje prawne prowadzące do głębszych zmian społecznych w postrzeganiu wartości i norm życia społecznego. Główny problem badawczy pracy, po ustaleniu, czym jest panika moralna, sprowadza się do pytania o głównych aktorów (podmioty) inicjujące panikę moralną, a następnie, biorąc pod uwagę złożony model decyzyjny stanowienia prawa, wskazanie, w jaki sposób panika moralna skutkuje fazą regulacji prawnej. Ponadto dysertacja stawia sobie również za cel próbę identyfikacji wartości społecznie doniosłych, które składają się na materialną racjonalność stanowienia prawa. Obok paniki moralnej pojawiają się inne określenia z obszaru społecznego kontekstu stanowienia prawa, czyli te narzędzia partycypacji społecznej, gdzie ujawni się, lub może się ujawnić, zjawisko paniki moralnej. Dysertacja wskazuje na elementy procesu stanowienia prawa istotne dla społecznego odbioru, które odpowiednio wykreowane powodują wzrost społecznego napięcia. Waga i doniosłość tematu została jednak odpowiednio wyreżyserowana. Całość działań pomiędzy mediami, opinią publiczną a polityką w kontekście paniki moralnej może zostać określona jako "gra o prawo".The work is devoted to the issue of moral panic in the area of lawmaking. It explains what moral panic is and indicates the stages of development of social anxiety in connection with the lawmaking process and the identification of entities that make legal decisions, leading to deeper social changes in the perception of the values and norms of social life. The main research problem of the work, after determining what moral panic is, comes down to the question: about the main actors (entities)initiating moral panic, and then, taking into account the complex decision-making model of lawmaking, to indicate how moral panic results in the legal regulation phase. In addition, the dissertation also aims to identify the social significant values that make up the material rationality of lawmaking. In addition to moral panic, there will also be other terms from the area of the social context of lawmaking, i.e. those tools of social participation where the phenomenon of moral panic will be revealed or may reveal itself. The dissertation point to the elements of the law-making process important for social perception, which, when properly created, cause an increase in social tension. The importance and importance of the topic, however, was properly staged. All activities between the media, public opinion and politics in the context of moral panic can be described as a "game for the law"
