Kompetencje biskupa diecezjalnego dotyczące wyższego seminarium duchownego w Polsce
Abstract
Tematem rozprawy doktorskiej są kompetencje biskupa diecezjalnego dotyczące wyższego seminarium duchownego w Polsce. Jej cel stanowi analiza ustawodawstwa powszechnego i partykularnego w przedmiocie wszystkich jego spraw. Źródła stanowi prawo powszechne i partykularne. Polskie ustawodawstwo znajduje się aktach Konferencji Episkopatu Polski i biskupów diecezjalnych. Literatura składa się z komentarzy do CIC/83 i opracowań autorów polskich i obcojęzycznych. Podjęta problematyka badawcza jest zawarta w trzech rozdziałach, rozbudowanych na mniejsze jednostki tematyczne i zwieńczonych podsumowaniem. Rozdział I składa się z wyjaśnienia podstawowych pojęć takich, jak: biskup diecezjalny, kompetencja i jej rodzaje, wyższe seminarium duchowne, jego rodzaje i geneza. Rozdział II ukazuje kompetencje biskupa diecezjalnego dotyczących wyższego seminarium w prawie powszechnym. Sukcesywnie zaprezentowano: kreacyjne, legislacyjne, decyzyjne dotyczące alumnów, liturgiczne i nadzorcze. Rozdział III zawiera analizę realizacji kompetencji biskupa diecezjalnego dotyczących wyższego seminarium duchownego w polskim prawie partykularnym. Struktura rozdziału odpowiada poprzedniemu, ale w celu zaprezentowania szczególnej aktywności polskiego ustawodawcy partykularnego została rozbudowana. Zakończenie zawiera reasumpcję badań i analiz oraz wnioski de lege lata i de lege ferenda. Rozprawa jest przygotowana przy użyciu metod: dogmatyczno-prawnej, teologiczno-prawnej i historyczno-prawnej.
The subject of the doctoral dissertation is the competence of the diocesan bishop regarding a major seminary in Poland. Its purpose is to analyze universal and particular legislation in all its affairs. Sources are universal and particular law. Polish legislation is in the acts of the Polish Bishops' Conference and diocesan bishops. The literature consists of commentaries to CIC/83 and studies by Polish and foreign authors. The research issues discussed in the dissertation are implemented in three chapters, extended to smaller thematic units and crowned with a summary. Chapter I consists of an explanation of the basic concepts such as: diocesan bishop, competence and its types, a major seminary, its types and genesis. Chapter II presents the powers of the diocesan bishop regarding a major seminary in universal law. Successively presented competences: creative, legislative, decision-making for alumni, liturgical and supervisory. Chapter III contains an analysis of the implementation of the competences of the diocesan bishop regarding a major seminary in Polish particular law. The structure of the chapter corresponds to the previous one, but has been expanded in order to present the particular activity of the Polish particular legislator. The conclusion includes a reassumption of research and analysis as well as de lege lata and de lege ferenda postulates. The dissertation is prepared using the following methods: dogmatic-legal, theological-legal and historical-legal.
