Abstract
Niniejsza praca poświęcona jest problemowi sprawiedliwości warunkowego umorzenia postępowania karnego. Autor wskazuje, że warunkowe umorzenie postępowania może stanowić sprawiedliwy środek reakcji karnej. Sprawiedliwość wymienionego środka powinna być jednak rozpatrywana w kontekście sprawiedliwości klasycznej, nie zaś wyłącznie sprawiedliwości naprawczej, która stanowi jedynie wycinek klasycznie pojmowanej sprawiedliwości. Autor w pracy wskazuje na szereg problemów, jakie w aktualnym stanie prawnym, rodzi instytucja warunkowego umorzenia postępowania, które wiążą się, w szczególności, z rozszerzeniem zakresu stosowania przedmiotowego środka dokonaną m.in. poprzez liberalizację przesłanki ustawowego zagrożenia karą. Autor zauważa że proces ten implikuje zmniejszenie stopnia sprawiedliwości warunkowego umorzenia postępowania. Proponuje także własne rozwiązania, które w jego ocenie uczynią samą instytucję warunkowego umorzenia postępowania, jak i jej stosowanie w praktyce, bardziej sprawiedliwym.
This dissortation examins the problem of justice in conditional discontinuance of proceedings. Above mentioned institution is alternative to punishment in traditional meaning The author shows that conditional discontinuance of proceedings can be a just measure of the criminal system response. The concept of justice in the above mentioned instrument should be analysed in the framework of classical justice and not only restorative justice, which is a mere part of justice in its traditional meaning. The author enlists problems arising from the institution of conditional discontinuance of proceedings in a current state of law, particularly associated with an extension of its scope of usage, including liberalization of statuory threat of punishment. The author notes that this process implicates a decrease in the level of justice in conditional discontinuance of proceedings. He also proposes his own solutions which, in his opinion, procure the institution of conditional discontinuance of proceedings and its administration to be more just.
