Abstract
Marian Ignacy Morawski SJ (1845 – 1901) należy do grona nieszablonowych uczonych XIX wieku. Filozof, teolog, pedagog, wykładowca akademicki. Zaskakującym jest fakt, że dotychczas spuścizna intelektualna Jezuity nie była interpretowana z punktu widzenia filozofii prawa. Nadszedł czas, aby spojrzeć na myśl krakowskiego neoscholastyka w szerszych ramach badawczych. Meandry filozofii prawa pozwalają na eksplorację myśli Mariana I. Morawskiego SJ z zupełnie nowej perspektywy. Zanurzenie się w dorobku intelektualnym Jezuity prowadzi do konstatacji, że myśl Morawskiego w dużej mierze jest uniwersalna i atemporalna. Z jednej strony, poglądy te stanowią kolejną odsłonę w odwiecznym sporze apologetów prawa pozytywnego ze zwolennikami prawa naturalnego, z drugiej strony są konstruktywną krytyką wobec prądów ideowych ewolucjonizmu, materializmu czy pozytywizmu, które wracają w bardziej wyrafinowanej formie ewolucyjnej filozofii prawa. Czym jest ,,zakon przyrodzony"? Jaka jest wzajemna relacja prawa i moralności w ujęciu Morawskiego? Jak XIX-wieczne prądy ideowe mają się do współczesnego dyskursu filozoficznoprawnego? Marian Ignacy Morawski SJ (1845 – 1901) belongs to the group of unconventional scientists of the nineteenth century. Philosopher, theologian, educator, university lecturer. It is surprising that, so far, the intellectual legacy of a Jesuit has not been interpreted from the point of view of the philosophy of law. The time has come to look at the mind of the Kraków neo-scholasticist in a broader research framework. The meanders of the philosophy of law allow the exploration of Marian I. Morawski S.J.'s thoughts from a completely new perspective. Immersing himself in the intellectual legacy of the Jesuit leads to the conclusion that Morawski's thought is to a large extent universal and atemporal. On the one hand, these views are another revision in the age-old dispute between apologists of positive law and supporters of natural law, on the other hand, they are constructive criticism against ideological currents of evolutionism, materialism or positivism, which return in a more refined form of the evolutionary philosophy of law. What is the "natural order"? What is the mutual relationship between law and morality in terms of Morawski? How do 19th-century ideological currents relate to contemporary philosophical and legal discourse? Answers to these questions and many others can be found in this book.
