Abstract
Dezinformacja dotycząca epidemii COVID-19 jest zjawiskiem globalnym. Stanowi zagrożenie dla wartości chronionych przez prawo, w szczególności dla zdrowia. Głównym problem artykułu jest pytanie, czy rozwiązania legislacyjne dotyczące dezinformacji na temat epidemii COVID-19, proponowane na poziomie europejskim i krajowym w Polsce, są kompatybilne? Analizy przeprowadzone w pracy prowadzą do wniosków, że kompatybilność rozwiązań legislacyjnych będących przedmiotem opracowania jest ograniczona. O ile możemy mówić o konsensusie dotyczącym oceny samego zjawiska dezinformacji, o tyle podejmowane działania, tak legislacyjne, jak i praktyczne na poziomie europejskim i na poziomie krajowym, w naszym przypadku w Polsce, pozwalają na wskazanie istotnych różnic i nierzadko niepokojących przesunięć akcentów. Porównując proponowane rozwiązania autorstwa Komitetu Ministrów Rady Europy (Rada Europy), Komisji Europejskiej (Unia Europejska) i krajowych projektów ustaw wyraźnie zauważalne jest odmienne podejście do idei zwalczania dezinformacji. Należy więc uznać, że sytuacja taka będzie prowadzić do powstania zróżnicowanych skutków prawnych projektowanych regulacji, które zdecydują między innymi o skuteczności projektowanych rozwiązań lub jej braku w praktyce. Analizując zagadnienia będące przedmiotem pracy, należy jednocześnie nieustannie pamiętać, że w demokratycznym państwie prawa zasadą jest wolność wypowiedzi.
Disinformation regarding the COVID-19 epidemic is a global phenomenon. It constitutes a threat to the values protected under the law, health in particular. The primary issue tackled in “Compatibility of legislative solutions regarding COVID-19 disinformation proposed at the European and national level in Poland paper is the attempt at answering the following question: Are the legislative solutions regarding COVID-19 disinformation, proposed at the European and national level in Poland, compatible? The analyses conducted under the paper lead to the conclusions that the compatibility of legislative solutions in question is limited. Although we may speak of a consensus concerning assessment of the very phenomenon of disinformation the legislative an Practical actions taken, both on the domestic level and the European level, enable us to indicate substantial and frequently disturbing differences regarding shifting the aspects emphasized by legislation. As compared to the proposed solutions drafted by the Committee of Ministers (Council of Europe), the European Commission (Europe an Union) and the drafts of domestic acts, the vastly different approach to the idea of controlling disinformation is clearly visible. Therefore it must be stated that such circumstances will lead to development of varied legal effects of the drafted regulations that will decide, among other issues, the practical effectiveness or lack thereof in the case of the drafted solutions. In the course of the analysis of the issue constituting the subject of this paper we should concurrently bear in mind that freedom of expression is one of the principles in a democratic state governed by the rule of law.
