Dowód elektroniczny w ogólnym postępowaniu administracyjnym w Polsce i w Ukrainie

Abstract

Artykuł jest poświęcony procesowi cyfryzacji dowodzenia w postępowaniu administracyjnym Polski i Ukrainy. Głównym celem badawczym jest rekonstrukcja istoty dokumentu elektronicznego oraz komparatywna ocena jego mocy dowodowej w procesie ustalania stanu faktycznego. Wykorzystując metodę dogmatyczno-empiryczną i prawno-porównawczą, sformułowano dwie tezy badawcze: 1) efektywność ustalania stanu faktycznego przy użyciu dowodów elektronicznych zależy od systemowej interoperacyjności usług zaufania i standardów technicznych; 2) pełne wykorzystanie dowodów elektronicznych jest determinowane poziomem kompetencji cyfrowych organów i stron, co może stanowić barierę w realizacji zasady dostępności cyfrowej organów administracji. Rozważania potwierdzają postawione tezy, dowodząc, że – mimo zasady równej mocy dowodowej – realizacja standardu dowodu elektronicznego może napotykać na bariery technologiczne i kompetencyjne. Ponadto prowadzą do wniosku, że system ukraiński wykazuje większą dynamikę w kierunku automatyzacji postępowania. W konkluzji, w odpowiedzi na postawione tezy sformułowano postulaty harmonizacji standardów międzynarodowych niezbędne dla wzajemnego uznawania dowodów w dobie integracji Ukrainy z UE, wskazano konieczność zastępowania tradycyjnej formy pisemnej trwałym nośnikiem elektronicznym oraz potrzebę systemowego wsparcia kompetencji cyfrowych pracowników organów administracji.

The article is devoted to the process of the digitalisation of evidence-taking in administrative proceedings in Poland and Ukraine. The main research objective is to reconstruct the essence of an electronic document and to provide a comparative assessment of its evidentiary value in the process of establishing the facts of the case. Using the dogmatic-empirical and comparative law method, two research theses were formulated: 1) the effectiveness of establishing the facts of the case through the use of electronic evidence depends on the systemic interoperability of trust services and technical standards; 2) the full utilisation of electronic evidence is determined by the level of digital competences of administrative authorities and parties, which may constitute a barrier to the implementation of the principle of digital accessibility of public administration bodies. The considerations confirm the proposed theses, demonstrating that – despite the principle of equal evidentiary value – the implementation of the electronic evidence standard may encounter technological and competence-related barriers. Moreover, they lead to the conclusion that the Ukrainian system demonstrates greater dynamism towards the automation of administrative proceedings. In conclusion, in response to the proposed theses, postulates for the harmonisation of international standards necessary for the mutual recognition of evidence in the context of Ukraine’s integration with the European Union were formulated. The need to replace the traditional written form with a durable electronic medium was indicated, as well as the necessity of systemic support for the digital competences of administrative authorities’ staff.
