| dc.description.abstract | W artykule przedstawiono status prawny rolnika jako kuracjusza. Opisano prawne płaszczyzny dostępu do rehabilitacji leczniczej w systemie ubezpieczenia społecznego rolników. Zgodnie z terminologią WHO and ILO dokonano ustalenia zakresu praw i obowiązków zakładów profilaktycznych służby zdrowia, jako podmiotów realizujących świadczenia rehabilitacji leczniczej, a także ustalono katalog podstawowych praw kuracjuszy w sanatoriach. Przedstawiono unikalne w skali europejskiej regulacje prawne, umożliwiające rolnikom oraz członkom ich rodzin uzyskanie statusu kuracjusza. Regulacje te zestawiono z aktualnym orzecznictwem krajowych oraz międzynarodowych sądów, trybunałów oraz organów komitetowych. Przedstawiono również, jak obecne rozwiązania ustawowe wyznaczające standardy opieki nad kuracjuszem, jako pacjentem w profilaktycznym zakładzie służby zdrowia, odpowiadają zaleceniom International Federation of Thermalism and Climatism, a w jakim stopniu polskie regulacje je przewyższają. | pl |
| dc.description.sponsorship | This article describes the legal status of farmers as sanatorium patients. The legal levels of access to therapeutic rehabilitation in the farmers’ social insurance system are outlined. The scope of rights and obligations of preventive healthcare institutions as entities providing therapeutic rehabilitation services are defined according to the World Health Organization and International Labour Organisation terminology, and a catalogue of basic rights of patients in sanatoriums is established. Unique in Europe, the regulations enabling farmers and their family members to obtain the status of sanatorium patients are presented. These regulations are compared with the current case laws of national and international courts, tribunals and committee bodies. The article also describes how the current statutory solutions setting the standards of care for sanatorium patients, as patients in preventive health care institutions, correspond to the international recommendations of, and to what extent Polish regulations exceed them. | pl |
