Delator w kanonicznym prawie karnym

Abstract

W prezentowanej rozprawie doktorskiej została podjęta próba odpowiedzi na pytania: Kim jest delator? Celem głównym niniejszej pracy, będzie próba wykazania instytucji delator w obecnym prawodawstwie kanonicznym, oraz powiązania z prawem rzymskim. Praca składa się z pięciu rozdziałów zakończonych podsumowaniami. Rozdział pierwszy dotyczy kształtowania się pojęcia delator. Następnie przedstawia rozwój tytułowego urzędu w historii prawa rzymskiego, wskazuje rolę w rzymskim procesie karnym, omawia status prawny, odpowiedzialność oskarżyciela rzymskiego oraz funkcję w prawie rzymskim. Rozdział drugi pt. „Delator w historii kanonicznego prawa karnego” odwołuje się do historii kanonicznego prawa karnego. Główna „esencja” pracy ukryta jest w ewolucji pochodzącego ze starożytnego prawa urzędu delator do jego ewolucji współczesnego promotora sprawiedliwości. Rozdział trzeci pt. „Ewolucja promotora sprawiedliwości w ustawodawstwie Kościoła” przedstawia wyjaśnienie pojęcia i rozwój urzędu promotora sprawiedliwości. Rozdział czwarty traktuje o innych urzędach kościelnych mogących stanowić odpowiedniki rzymskiego delator. W rozdziale piątym pt. „Rola delator w kanonicznym postępowaniu karnym” przedstawiono kwestie dotyczące roli delator w kanonicznym postępowaniu karnym.

In the presented doctoral dissertation, an attempt was made to answer the questions: Who is a delator? The main goal of this work will be an attempt to demonstrate the institution of delator in the current canonical legislation and its connections with Roman law. The work consists of five chapters ending with summaries. Chapter one titled "The formation of the concept of delator" concerns the formation of the concept of delator. Then it presents the development of the title office in the history of Roman law, indicates the role in the Roman criminal trial, discusses the legal status, responsibility of the Roman prosecutor and function in Roman law. Chapter two entitled "Delator in the history of canon criminal law" refers to the history of canon criminal law. The main "essence" of the work is hidden in the evolution of the office of delator from ancient law to its evolution of the modern promoter of justice. Chapter three entitled "The evolution of the promoter of justice in the legislation of the Church" presents an explanation of the concept and the development of the office of the promoter of justice. The fourth chapter deals with other church offices that may be equivalents of the Roman delator. In chapter five entitled "The role of the delator in canonical criminal proceedings" presents issues regarding the role of the delator in canonical criminal proceedings.
