Rola Państwowej Inspekcji Pracy w systemie prewencji przestępczości seksualnej i ochronie małoletnich

Abstract

Artykuł obejmuje analizę ustawowej roli Państwowej Inspekcji Pracy jako podmiotu zobowiązanego do działań w zakresie prewencji przestępczości seksualnej oraz ochrony małoletnich. Celem pracy jest ustalenie instrumentów przysługujących PIP w obszarze realizacji założeń przeciwdziałania zagrożeniom przestępczością na tle seksualnym. W artykule przeanalizowano założenia systemowe prewencji na gruncie ustawy z dnia 13 maja 2016 r. o przeciwdziałaniu zagrożeniom przestępczością na tle seksualnym i ochronie małoletnich w kontekście uprawnień kontrolnych PIP. Oceniono aktualne uprawnienia PIP przy uwzględnieniu zarówno systemu prewencji przestępczości seksualnej, jak i postępowania karnego oraz kompetencji tego organu na gruncie ustawy o Państwowej Inspekcji Pracy. Przeprowadzona analiza pozwoliła na sformułowanie postulatów de lege ferenda w postaci rozszerzenia uprawnień PIP odnośnie do kontroli wprowadzenia standardów ochrony małoletnich, jak również wniosków de lege lata w zakresie uprawnienia do powiadamiania organów ścigania o naruszeniach prawa, które wykraczają poza obszar kontroli.

The article provides an analysis of the statutory role of the State Labour Inspection as an entity obliged to undertake activities in the field of sexual crime prevention and the protection of minors. The aim of the study is to identify the instruments available to the State Labour Inspection in implementing the objectives of counteracting threats related to sexual offences. The article analyses the systemic premises of prevention under the Act of 13 May 2016 on Counteracting Threats of Sexual Offences and the Protection of Minors, in the context of the inspection powers of the State Labour Inspection. The current powers of the State Labour Inspection were assessed with due regard to both the system of sexual crime prevention and criminal proceedings, as well as the competences of this authority under the Act on the State Labour Inspection. The analysis conducted made it possible to formulate de lege ferenda proposals in the form of extending the powers of the State Labour Inspection with regard to monitoring the implementation of standards for the protection of minors, as well as de lege lata conclusions concerning the authority to notify law enforcement agencies of legal violations that fall outside the scope of inspection.
