dc.description.abstractRegularne świadczenie przez banki usług finansowania krótkoterminowych wierzytelności handlowych dostawców albo odbiorców towarów i usług doprowadziło do wykreowania nowego typu umowy – umowy o świadczenie usług efinancing. Jednak wykreowanie tego rodzaju umowy nasuwa wiele jurydycznych wątpliwości. Jaki jest przedmiot umowy o świadczenie usług efinancing? Czy jest ona nową umową nienazwaną, czy tylko rzadko wykorzystywaną odmianą umowy nazwanej? Które z istniejących regulacji prawnych znajdują zastosowanie do tego typu umowy? Jakie problemy prawne występują na tle umowy o świadczenie usług efinancing? Niniejszy artykuł jest próbą odpowiedzi na powyższe pytania. The regular provision of financing services by banks for short-term trade receivables of suppliers or recipients of goods and services has led to the creation of a new type of contract, i.e. an agreement for the provision of efinancing services. However, the creation of this type of contract raises many juridical doubts. What is the subject of the contract for the provision of efinancing services? Is an efinancing contract a new unnamed contract, or just a rarely used variation of a named contract? Which existing legal regulations apply to this type of contract? What legal problems occur in relation to the contract for the provision of efinancing services? This article is an attempt to answer the above questions.
