Abstract
Rok 2017 jest to rok bogaty w wydarzenia legislacyjne z zakresu ochrony zabytków. Między innymi, w związku z wejściem w życie w dniu 9 września 2017 r. ustawy z dnia 22 czerwca 2017 r. o zmianie ustawy o ochronie zabytków i opiece nad zabytkami oraz niektórych innych ustaw (Dz. U. poz. 1595), która usunęła z ustawy o ochronie przyrody zezwolenie na usunięcie drzew lub krzewów z terenu nieruchomości wpisanej do rejestru zabytków lub jej części, wydawane przez wojewódzkiego konserwatora zabytków, dalsze prowadzenie badań zakresie nim objętym (zezwolenia wojewódzkiego konserwatora zabytków) byłoby pozornie niecelowe. Nowelizacja ta czyni bezprzedmiotowymi badania oraz publikację ich wyników w zakresie zezwolenia na usunięcie drzew lub krzewów z terenu nieruchomości wpisanej do rejestru zabytków lub jej części. Pozostawione w ustawie o ochronie przyrody dwa inne przepisy związane z działaniem wojewódzkiego konserwatora zabytków jako organu opiniodawczego nie dawały autorowi potencjalnej książki zbyt wielkich podstaw do sporządzenia w tym wąskim zakresie monografii książkowej, ani być może monograficznego artykułu w czasopiśmie.
Jednak brak przedmiotu analizy prawnej to tylko pozory. Nieprzypadkowo stan prawny tej monografii określony jest datą 24 listopada 2017 r. W tym dniu Sejm RP uchwalił ustawę o zmianie ustawy o ochronie przyrody oraz ustawy o ochronie zabytków i opiece nad zabytkami (druk sejmowy 1977). W czasie pisania niniejszej książki ustawa ta jeszcze nie obowiązywała, jeszcze nie było wiadomo, jaki będzie stan prawny po pracach w Senacie RP i ewentualnych zastrzeżeniach Prezydenta RP, ale jedno było wiadomo na pewno – Sejm zmienia poglądy na decyzję w sprawie usuwania drzew lub krzewów z terenu nieruchomości lub jej części wpisanej do rejestru zabytków. Zmiana ta zachodzi w odstępie kilku miesięcy w sposób rewolucyjny.
Niniejsza monografia nosi tytuł "Decyzja administracyjna w sprawie usunięcia drzew lub krzewów z terenu nieruchomości lub jej części wpisanej do rejestru zabytków”.
2017 is a year rich in legislative events in the field of monument conservation. Among other things, in connection with the entry into force on September 9, 2017 of the Act of June 22, 2017 amending the act on protection and guardianship of monuments and certain other acts (Journal of Laws, item 1595), which removed from the nature conservation act the permission to remove trees or shrubs from the real estate or its part listed in the register of monuments, issued by the Provincial Monument Conservator, further research covered therein (permit of the Provincial Monument Conservator) would seem pointless. This amendment makes the research on permissions for the the removal of trees or shrubs from a real estate or its part listed in the register of monuments as well as the publication of findings irrelevant. Two other provisions remaining in the Act on nature conservation, related to the operation of the Provincial Monument Conservator as an opinion-giving body did not give the author of the potential book too extensive grounds for drawing up a monograph or a monographic article in a journal. However, this lack of the subject of legal analysis is only a semblance. It is not a coincidence that the legal status of this monograph is set on 24 November 2017. On that day, the Parliament–the Sejm of the Republic of Poland passed an act amending the nature protection act and the protection and guardianship of monuments act (Sejm print 1977). At the time of writing this book, this law was not yet in force, it was not known yet what the legal status would be after the proceedings in the Polish Senate and possible reservations of the President of the Republic of Poland, but one thing was certain - the Sejm changed its views on the decision on removing trees or shrubs from the real estate or its part listed in the register of monuments. This change is taking place within several months in a revolutionary way. This monograph is entitled "Administrative decision on the removal of trees or shrubs from a real estate or its part listed in the register of monuments".
