Umowa wspólnego rachunku bankowego i dziedziczenie zgromadzonych na nim środków

Celem niniejszego opracowania jest ocena obowiązujących regulacji dotyczących umowy rachunku wspólnego, ze szczególnym uwzględnieniem problemu dziedziczenia udziału zmarłego współposiadacza. Zmierzono się z odpowiedzią na pytanie, czy obowiązujące przepisy rozstrzygają kwestię losów takiego rachunku po śmierci jednego z posiadaczy oraz zaproponowano kierunki zmian legislacyjnych w tym zakresie. Zasygnalizowano również potrzebę nowelizacji przepisów w przedmiocie rozszerzenia kręgu posiadaczy rachunku wspólnego o kategorię osób prawnych. The purpose of the present article is the evaluation of regulations regarding joint bank accounts, in particular with reference to the issue of inheriting the share of the deceased holder. This study tackles the issue of whether the current regulations provide an answer to the question if the account should continue as sole ownership or the account agreement should be terminated. It also indicates the most requisite amendments in the regulations to clarify the issue stated above, as well as some postulates towards enlargement of the group of prospective joint account holders by adding the category of legal persons.
