    Zarzut jako środek prawny w egzekucji administracyjnej

    Niniejsze opracowanie dotyczy problematyki jednego z najczęściej wykorzystywanych w praktyce, w toku postępowania egzekucyjnego, środka prawnego ochrony zobowiązanego, jakim jest zarzut. Zagadnienie to ma szczególnie istotne znaczenie z praktycznego punktu widzenia, ocenianego przez pryzmat praw i obowiązków podmiotów uczestniczących w tym postępowaniu, tj. dla organu egzekucyjnego, wierzyciela, a w szczególności dla zobowiązanego. Omawiane zagadnienie jest tak ważne bowiem dotyczy ochrony praw zobowiązanego w szczególnie dotkliwym dla niego postępowaniu, jakim jest postępowanie egzekucyjne. W niniejszym opracowaniu dokonano analizy i oceny przepisów, w kontekście bardzo obszernych zmian w zakresie zarzutu, które zostały wprowadzone do ustawy o postępowaniu egzekucyjnym w administracji od dnia 30 lipca 2020 r. Zwrócono uwagę na znaczący wzrost pozycji wierzyciela w badaniu i rozstrzyganiu o zasadności zarzutu oraz na zmiany dotyczące trybu postępowania w sprawie zarzutu. W oparciu o dokonane ustalenia sformułowano wnioski końcowe. This study concerns the issue of one of the most frequently used in practice, in the course of enforcement proceedings, means of legal protection of the obliged party, which is a complaint. This subject is particularly important from a practical point of view assessed through the prism of the rights and obligations of entities participating in these proceedings, i.e., for the enforcement authority, the creditor, and, in particular, for the obliged party. The discussed issue is essential as it concerns the protection of the rights of the obliged party in procedures which are particularly severe, such as enforcement proceedings. In this study the authors analyzed and assessed the provisions within the scope of the complaint, in the context of very extensive changes introduced to the Act on Enforcement Proceedings in Administration from 30 July 2020. Attention has been drawn to the significant increase in the position of the creditor in the examination and adjudication of the legitimacy of the complaint, as well as to the changes in the procedure concerning the complaint. Based on the findings, final conclusions were drawn.
