- Item« À quoi bon se parler avec la voix quand on se peut parler avec l’âme ? » Le silence dans les textes narratifs de Marie Krysinska(2017) Wierzbowska, Ewa M.Literature is filled with silence, which, being polysemic, is a medium much harder to decipher than a word, whose semantic bearing capacity is more limited. To explore silence is to try to gain access to something most intimate, something that does not want to – or cannot – appear in verbal form. In Krysinska’s selected texts one observes silence on two levels, the narrative level and the story level. In most cases, we are dealing with a communicative silence. On the story level, characters use silence as an efficient way of achieving their goals or they are forced into silence by external factors. In many cases silence is imposed on the characters, it is not their choice, for in the given situation they could not utter even a single word. On the narrative level it is the narrator who condemns characters to the role of quasi-mutes, for any statements from characters are relatively rare. The narrator does not allow them to speak freely, he uses reported speech. He exercises active control over the reader, skilfully directing their reception and forcing them to accept his point of view.
- ItemAxiological paradigm of social inclusion intensification - selected remarks(Wydawnictwo KUL, 2019) Małecka-Łyszczek, Magdalena Iwona; Mędrzycki, RadosławThe following paper investigates the values building the axiological paradigm of social inclusion intensification using the legal doctrine. The analysis is set within the Polish legal system, which is part of the international and EU law established for the maintenance of social cohesion. On the one hand, the Polish solutions not only stem from the European civilization heritage, but also create and reinforce it. The individual sections of the paper provide an analysis of such inclusive values as dignity, freedom, equality, common good and social solidarity which are assumed to be the basis for all inclusive actions performed within civil societies in democratic states based on the rule of law. The analysis also considers a possible hierarchy of those values and how they affect each other. While the inclusive values themselves appear to be universal, their relations and influence on each other (possibly: hierarchy) is strictly dependent on the national legislation. The research has shown the way in which the investigated values/principles coexist. Human dignity has been found to be the fundamental and supreme value of the Polish legal system, while social solidarity supports social cohesion. It is not possible to artificially separate those values – only when they intertwine, complete and enhance each other can the inclusive actions be designed and executed in the most advantageous manner. Therefore, values and rules which bear them form a praxeological system; they must be interpreted only within the context of their coexistence, relations and the influence they have on one another. Each of the discussed values takes part in the establishment of the resources shared by a democratic state and by the internal structures of the civil society existing within this state’s bounds. Only by taking them all into consideration can we provide an adequate and comprehensive understanding of inclusivity and achieve its desired model.

La liaison de Louis XIV et de La Vallière pose un double problème religieux et politique. À cet égard, Bossuet utilise la topique de la vanité comme une arme paradoxale qui montre que le mépris du monde ne peut se passer du monde. Le champ religieux et le champ public se reflètent alors sans cesse l ’un dans l ’autre.

D ’où ces questions : doit-on réduire son oeuvre à une vaine ποικιλíα, un exercice de rhétorique égocentrique procédant du miroitement et de la profusion, ou doit-on considérer son auteur comme un moraliste, continuateur de Pascal et donc un « monstre incompréhensible » à son siècle ?
- ItemClimate Change Impact On The Human Right To Environmental Conditions Of A Specified Quality (safe, clean, healthy and sustainable environment): Some International Environmental Law Issues(Wydawnictwo KUL, 2019) Sushyk, Olha; Shompol, OlenaThis article discusses recognition between climate change and human rights at the international level. The analysis shows that despite the UN climate change framework does not adequately address the magnitude of the threat posed by climate change related harm to human rights, domestic, regional or international courts must take account of its provisions in deciding cases. The article argues that the causes for climate cases are diverse, whereby the most often ones are those referring to the competent public authority’s failure to fulfil its obligation to regulate limitations of the greenhouse gas (GHG) emissions. Further identify the links between human rights and environmental protection, were apparent at least from the first international conference on the human environment, held in Stockholm in 1972. More broadly, it demonstrates international environmental agreements, were some aspects of the right to environmental conditions of a specified quality are identify. This article discusses also theoretical issues of individual environmental rights and the right to environmental safety in Ukraine.
- ItemCommunitarian And Intergovernmental Dimension Of EU Visa Law(Wydawnictwo KUL, 2019) Cesarz, MaciejThis article explores the development of EU visa policy with special emphasis put on legal and institutional dimensions. Basing on a formal analysis of primary and secondary law of the European Union and literature on the subject, it claims that intergovernmental roots of common visa policy strongly affect the current structure of EU regulations on visas. The research is focused on the formal development in this area of integration with particular attention paid to the intergovernmental dimension which is still present in the framework of the Schengen visa regime. Visa facilitation agreements as part of EU visa law as well as political determinants of common visa policy are also examined. The article concludes that visa issuing still remains a complex matter, characterized by dispersion of visa acquis due to separate provisions that still remain in force and which presents a mix of hard and soft law. Since the Member States have retained the right to issue national, long-term visas and the national practice of issuing uniform visas remains varied, European integration in the area of visas is still incomplete.
- ItemCooperation Between Institutions of the European Union and Its Member States in the Creation of Climate Protection Policy(Wydawnictwo KUL, 2019) Świat, Piotr; Bukowska, JoannaThe climate policy is a complex area of cooperation between Member States and the European Union institutions. The ambitious goals that the EU sets for itself in this matter are not always possible to be met by all Member States, hence the ability to work out compromise solutions is of great importance. Member States have various internal conditions, which determine the objectives of their economic and energy policies, therefore they do not always have convergent interests in this area. The decision-making centre where the EU climate protection policy is created is: the European Council, where key elements of this policy are agreed (such as reduction targets), and the so called an ‘institutional triangle’, i.e. the EU Council, European Parliament and European Commission which are directly involved in the legislative process. This configuration is a platform where cooperation of the Member States manifests itself in various forms and intensity and where those countries may attempt to force their interests in the process of creating the EU policy. The article presents the legal bases of the European Union’s competences in the field of the climate policy and the role of the EU institutions in its creation with particular focus on mechanisms that allow Member States to influence the shape of that policy.
- ItemCoping With Neo-Nomadic Mobility: Frontex’s Agent Power In The EU’s Extended Borderland(Wydawnictwo KUL, 2019) Gruszczak, ArturMigration movements to Europe, triggered by dramatic political and social developments in North Africa and the Middle East, have contributed to a decrease in the level of security in the European Union and to the crisis of this organization. This article addresses the issue of migration in the context of the phenomenon of neo-nomadism and its effects on the policies of the member states of the European Union, as well as its institutions and agencies. The consequences of neo-nomadism are analyzed in regard to the EU’s "extended borderland" on the example of the activities of the European Border and Coast Guard Agency (Frontex) in the Central Mediterranean. Frontex’s joint operations "Triton" and "Themis" serve as a useful frame of reference in examining this agency’s "agent power" expressed in activities concerning migratory movements in the EU's "extended borderland". The hypothesis developed in this article holds that the dynamics of mobility resulting from the specific features of neo-nomadism activates the "agent power" of entities involved in mobility and border management in two forms: inclusionary, for humanitarian reasons, and exclusionary, for the sake of security. As an agency responsible for supporting the management of the EU's external borders and implementing return policy, Frontex has concentrated its agent power on securing territory, borders and population at the expense of humanitarian search-and-rescue operations. Joint operations "Triton" and "Themis" have clearly highlighted the trend towards an exclusionary approach to migrants. Post-functionalism referring to the original conceptualisation put forward by Hooghe and Marx is the theoretical frame adopted in the present study. The research method is qualitative, based on desk research including the analysis and interpretation of primary and secondary sources.

Rejecting the reality, the writer resignes also from the scene’s materiality what leads him as a consequence to the deconstruction of the space-time’s categories. Traditional drama’s division on act and scenes is replaced by the loose images (tableaux) where the dreamy visions mingle with reality. Puting the pressure on oniric dimension of a play, the playwright prepares the area for a break of characters who moving in a hostile and an unspecified world without the laws of physics, get going in quest for the lost identity. Breaking the unity of action and psychological consistency of a character, Pellerin presents the crisis of a temporary human being, moreover by using heterogenic forms, he shows this crisis in ist best.

Sevré pour ainsi dire de ses parents, il est obligé de vivre au village aux côtés de sa grand-mère Iyo. Il fonde sa quête sapientiale journalière sur un questionnement répétitif qu’il formule à l’endroit de son maître. Mais par-delà la fascination de l’enfant et face à l’immensité des modules de formation, quels types de liens singularisent-ils son rapport à Iyo ? Un accompagnement didactique pour le maître ou simplement une guidance pour l’apprenant ? En adossant notre analyse au diptyque phénotexte-génotexte qui sous-tend l’approche sociocritique d’Edmond Cros, nous organisons notre travail en deux grandes parties. D’abord, nous scrutons les composantes thématiques qui articulent l’apprentissage de Mwana en montrant à chaque fois comment l’artiste-écrivain stylise cette thématique pour enfin interroger la vision du monde qu’il postule à travers son écriture.
- ItemDialogue de la littérature et la peinture dans Femmes d’Alger dans leur appartement d’Assia Djebar(2016) Gubińska, MariaThe paper presents the phenomenon of hybridity present in Assia Djebar’s writings based on the example of the collection of short stories entitled Femmes d’Alger dans leur appartement (Women of Algiers in Their Apartment). The title of the collection makes reference to famous paintings by Delacroix and Picasso but in doing so the author also supplements the Europocentric discourse with her own voice, the voice of a Francophone Algerian writer who, holding a dialogue with the painters, breaks with exoticism and the orientalising European approach. The dialogue with painting is accomplished on two levels; the first, diegetic and second, essayistic; in ‘The Overture’, and especially in ‘The Afterword’, which is not only a commentary to the painting works by Delacroix and Picasso, but also a complementation of the literary plot. The permanent link of Djebar’s writings to the dramatic present and the remembrance of the women deprived of their voice and subjected to reification is voiced powerfully in the work, which cannot be easily evaluated as it is very diverse in its references to other fields of art.
- ItemDu disciple au maître : Victor Segalen et Paul Gauguin(2019) Kukuryk, AgnieszkaL’idée de cet article vise à présenter une relation particulière entre le peintre et le poète, et à examiner les influences de la vision de Gauguin, que Segalen nomme Maître-du-Jouir, sur la création littéraire de l’écrivain. Les deux Français avaient beaucoup en commun: un sens du mystère, une fascination pour le primitif et l’exotique et un don pour l’ambiguïté. À partir de 1903 jusqu’à sa mort en 1919, la poésie et la prose de Segalen tenteront, à l’instar de l’art de Gauguin, de découvrir l’exotisme à sa manière tout en confrontant de plus en plus les limites du pouvoir d’appréhension de l’artiste occidental. Dans Les Immémoriaux, Segalen adopte un point de vue maori pour commenter la culture occidentale. Le plus grand exploit de l’auteur était de rompre avec l’exotisme colonial d’écrivains voyageurs du XIXe siècle, à titre d’exemple Pierre Loti. Là où ces auteurs ne prétendaient pas renoncer aux valeurs occidentales, voire impériales, tout en décrivant des cultures étrangères, Segalen, imitant son Maître Gauguin, était extrêmement conscient de ses représentations de l’autre de manière particulièrement moderne. Segalen réalise dans son roman ethnographique une sorte de translation d’un art à l’autre qui est, pour lui, une démarche créatrice par elle-même.
- ItemEntre dentelle et fragment: évolution de la tactique du vide rimbaldienne de la Saison aux Illuminations(2017) Hammoudi, RafikaA Season in Hell and Illuminations both of these collections are considered as masterpieces of Rimbaud’s poetry. Whereas A Season in Hell is presented as his artistic testimony, Illuminations, on the other hand, is considered by critics as an abstruse writing, an enigma. Acknowledging critical scholarship on this topic, as well as inherent differences of both collections, this article will show that a link could be found between these two works. This thread, which creates what we would like to call Rimbaud’s embroidery, was created by himself through silence and words. That is this will of Rimbaud for both works and the readers that we will discuss here, a strategy that we have named: Tactic of Emptiness.
- ItemEntre la danse macabre et l’apologie de la vie, ou les vanités selon Joris-Karl Huysmans(2018) Litwinowicz, ZofiaDans l’œuvre huysmansienne, en particulier celle de la transition entre sa phase décadente, marquée par Là-bas (1891), et la période du naturalisme mystique, dont le fruit le plus mûr reste La Cathédrale (1898), il est possible de retracer la transformation complète et profonde du traitement de la vanitas. Le présent article propose une analyse de trois étapes de cette évolution. Il part de la vanitas macabre de Là-bas, proche de l’esthétique de Félicien Rops, auquel Huysmans s’intéresse dans les années 1880, et du motif de la tentation de saint Antoine dans les arts de la fin du Moyen-Âge et du début de Renaissance. Ensuite, il examine l’approche huysmansienne à la Crucifixion de Cassel et au retable d’Issenheim de Matthias Grünewald, qui constitue un passage entre l’esthétique de la danse macabre et celle du naturalisme mystique. Finalement, il étudie le legs des ekphraseis de Grünewald: l’apologie de la vie et un regard nouveau sur la vanitas dans La Cathédrale.
- ItemÉric-Emmanuel Schmitt et ses maîtres de bonheur : à la croisée des voies littéraire et musicale(2019) Robova, AntoanetaDans plusieurs œuvres à éléments autobiographiques, Éric-Emmanuel Schmitt révèle la genèse musicale de sa vocation d’écrivain en soulignant le rôle de quelques compositeurs ou bien en décrivant la maïeutique pédagogique mise en œuvre par ses professeures de piano. L’objectif de cet article est d’étudier le rôle (trans)formateur de l’apprentissage musical et plus particulièrement de l’initiation à la musique de Mozart, Beethoven et Chopin. Guides spirituels et maîtres à penser, ces compositeurs ont marqué le parcours existentiel et artistique d’Éric-Emmanuel Schmitt et ont inspiré sa propre aventure esthétique. La rencontre salutaire avec Mozart a induit la naissance de l’amour spirituel et a engendré le processus de conversion scripturale et de transmission créatrice. Le disciple mozartien réinvente sa vocation et transpose dans son œuvre littéraire des particularités de la philosophie musicale de ses maîtres de sagesse en s’inscrivant dans une logique de filiation spirituelle et esthétique.
- ItemEU-Japan Agreements: Content, Context and Implications(Wydawnictwo KUL, 2019) Kuźnar, Andżelika; Menkes, Jerzy BrunonW artykule analizowane są zawarte umowy UE z Japonią: Umowa o Partnerstwie Gospodarczym (EPA) i Umowa o Partnerstwie Strategicznym (SPA) i umowa negocjowana: Umowa o ochronie inwestycji. EPA liberalizuje handel towarami i usługami. Ustanawiając ramy prawne partnerstwa strategicznego, umowa o partnerstwie gospodarczym ułatwia współpracę w obliczu wspólnych wyzwań. IPA będzie regulować standardy ochrony inwestycji i rozstrzygania sporów. Analiza obejmuje: - treść umów; - społeczno-gospodarczy i polityczny potencjał stron; - zdolność prawną UE do negocjowania i zawierania umów z Japonią oraz jej kompetencje, wyłączne lub dzielone, w obszarze umów; - znaczenie umów dla ich stron i innych aktorów międzynarodowych, jak również dla stosunków regionalnych, transregionalnych i globalnych. Sformułowana jest teza, że w świecie, w którym wzrasta niestabilność i zmniejsza się bezpieczeństwo, strony wywiązują się ze spoczywającego na nich, jako na wielkich mocarstwach, obowiązku ponoszenia szczególnej odpowiedzialności za wdrażanie reprezentowanych wartości. Umowy potwierdzają wspólnotę wartości, na których są osadzone i stwarzają warunki do ich wzmocnienia. Artykuł składa się z pięciu części. Najpierw analizowany jest przedmiot umów (część I: Co?), następnie strony (część II: Kto?) oraz powody zawarcia (część III: Jak (modus operandi) i dlaczego (w ten sposób). W części IV (Waga umów) wskazano znaczenie umów dla stron i społeczności międzynarodowej, w części V (Umowy w pryzmacie stosunków wielostronnych) skoncentrowano się na umowach postrzeganych z perspektywy zewnętrznej. W konkluzjach stwierdzono, że umowy instytucjonalizują wspólnotę bezpieczeństwa UE-Japonia most łączący dwa brzegi Pacyfiku, w którym komponent dotyczący polityki bezpieczeństwa i obrony jest nadal stosunkowo słaby, ale rozwijany. Umowy zacieśniające więzi polityczne i gospodarcze między UE a Japonią otwierają drogę do stworzenia wspólnoty bezpieczeństwa UE z "demokratycznymi diamentami" Azji i Pacyfiku.
- ItemExtreme Material Poverty As A Negative Prerequisite For The Transfer Of An Applicant For International Protection To The Competent Member State And For The Rejection Of An Application For The Grant Of Refugee Status As Being Inadmissible(Wydawnictwo KUL, 2019) Wróbel, IzabelaThe essential measures for a common European asylum system adopted by the EU institutions include the Regulation (EU) No 604/2013 and the Directive 2013/32/EU. These acts relate to the various stages of the functioning of the common European asylum system, however, there may be a risk of a violation of the fundamental rights of applicants as set out in the Charter of Fundamental Rights of the EU, including the prohibition of inhuman or degrading treatment (Article 4 of the Charter), at both stages. Such a risk may arise as a result of deficiencies in asylum systems of the Member States. If these deficiencies are to fall within the scope of Article 4 of the Charter, they must attain a particularly high level of severity, which depends on all the circumstances of the case. An example of attaining this particularly high level of severity is the situation of extreme material poverty. As acts of the EU asylum law do not contain the terms “particularly high level of severity” and “extreme material poverty” and all the more they do not define them, guidelines on how to interpret and apply Article 4 of the Charter in the context of the common European asylum system should be sought in the case law of the Court of Justice of the EU. Therefore, the aim of the article is to explore and attempt to generalise and develop the basis and the criteria indicated by the CJEU for assessing the actual nature of deficiencies in the asylum system of the Member State in question from the point of view of the prohibition laid down in Article 4 of the Charter, with particular emphasis on the criterion of a particularly high level of severity and the situation of extreme material poverty which meets this criterion.
- ItemFlocart et Florimont, le miroir et le prince(2019) Leclercq, NathalieFlorimont, d’Aimon de Varennes, un trouvère lyonnais du XIIe siècle, semble avoir été écrit en 1188, mais sa datation demeure incertaine. Ce roman narre comment un jeune homme, profondément épris d’une fée, est amené à trahir malgré lui celle qu’il aime, perdant ainsi son amour et comment, après bien des souffrances, le jeune héros se console auprès d’une autre et devient roi. Tout au long des aventures de Florimont, son maître Flocart l’accompagne, le guide et l’éduque par des discours fortement moralisateurs. Nous nous proposons d’étudier comment ce personnage, qui, selon Katalin Halász, participe d’un pouvoir supérieur ou de l’omniscience du narrateur, construit sa relation avec son élève, dans un but d’édification individuelle et collective. Nous verrons tout d’abord que Flocart assume une double fonction diégétique qui favorise le processus d’individuation de son élève. Nous montrerons ensuite que ses multiples interprétations des rêves lui confèrent le rôle de maître de vérité qui sacralise le destin de Florimont. Nous observerons, enfin, que les discours parémiologiques de Flocart prennent des allures de miroir aux princes propre à révéler à son jeune élève les principales qualités d’un bon roi en plaçant la largesse au cœur des relations humaines et politiques.
- ItemHybridité artistique et hybridité identitaire dans Tels des astres éteints (2008) de Léonora Miano(2016) Kana Nguetse, PaulIf there is an aesthetic that characterizes the novel Tels des astres éteints writing by Leonora Miano, it is the combination of literary art and the art of music. This artistic hybridity that starts from paratexts transforms the novel into iso-epistemic space and into an archive of memory discography. For this poetic hybrid, the author expands the fields of observation and intensifies cognitive quest (Krysinski, 2004). It is also a scriptural technical mobilized to translate and defend the identity hybridity.
- ItemHybridité et altérité dans Magnus de Sylvie Germain(2016) Jauer, AnnickMagnus, a novel from Sylvie Germain published in 2005, is a narration made up of several marks of hybridity – structural, generic and discursive hybridity. Those marks are not simply formal but emphasize the necessity of a true presence towards the world and others. The itinerary of the character is a spiritual one, and the novel reveals the part played by reading and writing in the reconsideration of our relationship towards the world and the other people.
