- ItemBezpieczeństwo prawne w orzecznictwie polskiego Trybunału Konstytucyjnego(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2006) Potrzeszcz, JadwigaIn the present article, an analysis and interpretation has been made of the judicial decisions of the Polish Constitutional Tribunal in order to examine the way the concept of reliability of a legally established order is understood by that court of justice. The examination has been conducted from the point of view of the needs of an individual and his sense of security. A classification of particular rules has been made by means of the criteria of demands that come from the individual who wishes to feel safe under the rule of law. These conditions for security include a positive character, practicability and stability of the law.

- ItemFilozofia prawa Czesława Martyniaka w kontekście współczesnej dyskusji wokół paradygmatu niepozytywistycznej koncepcji prawa(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2010) Potrzeszcz, JadwigaIn the contemporary philosophical-legal debate in Poland, a growing interest in the nonpositivist conception of law may be noticed. It is a conception, which, contrary to the positivist conception, assumes, inter alia, the thesis about the necessity of the existence of a connection between law and morality. The aim of the present article is to show how topical Czesław Martyniak’s philosophicallegal thought is in the context of the contemporary debate about the paradigm of the nonpositivist conception of law. It turns out that if we compare the theses advanced by contemporary followers of neo-positivism with Czesław Martyniak’s views of the essence of law, we can find several related points. First of all this concerns the thesis about the necessity of the existence of a connection between law and morality, but also the non-positivist thesis about the ontological complexity of law, the very definition of law, and the issue of its binding force. In the final part of the article the author comes to the conclusion that although the contemporary debate about the concept and nature of law has reached a high level of sophistication, in fundamental questions it has not added anything new to what was said by Czesław Martyniak more than seventy years ago. However, today it is worth discussing the non-positivist conception of law, because such a discussion offers constructive criticism of legal positivism that is significant in practice. It tends towards improving the quality of positive law by taking into consideration also the demands of its validity and justice.

All individual rights and freedoms derive from man's natural and inalienable dignity, as it is expressly said in art. 30. The article is a indirect reference to natural law in its Tomistic conception. According to this conception, the essence of the dignity of the human person is existence itself in a certain manner. All people from the very beginning of their existence have personal dignity, irrespectively of their current possibilities to act. In view of this, everyone is equally entitled to human rights. It follows from analyses of particular norms of human rights that the principle of dignity is not consequently carried out.
- ItemFilozoficznoprawna droga Arthura Kaufmanna(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2011) Potrzeszcz, JadwigaThe legal philosophy of Arthur Kaufmann (1923-2001), a German legal philosopher and the most prominent disciple of Gustav Radbruch, focuses on the "third way" between legal positivism and natural law. The legal philosophical way of his thought is not possible to comprehend fully without a methodological division into three areas: 1) ontology of law, 2) legal hermeneutics and 3) personal philosophy of law. It must be stressed that boundaries between these domains are not clear. They cannot be delineated with precision and unambiguously, as the thoughts that prevail in one domain are to be found in earlier publications, while new considerations that gradually become prominent are linked with earlier ones.
- Item„Formuła Radbrucha” a „formuła Cathreina”(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2011) Potrzeszcz, JadwigaAn analysis of Victor Cathrein’s comment on values and positive law allows one to extract such formulations that can be called, by way of analogy to the Radbruch formula, the Cathrein formula. A comparison of views held by Gustav Radbruch and Victor Cathrein has not been, it seems, a subject of legal-philosophical research. Radbruch himself never directly pointed to his inspiration by Cathrein’s views, although he was well acquainted with the legal-philosophical work entitled: Recht, Naturrecht und positives Recht. Eine kritische Untersuchung der Grundbegriffe der Rechtsordnung (Freinburg im Breisgau, 1901). In 1911, he wrote a review of the second edition of 1909. Although Gustav Radbruch is known as a representative of Baden School of Neo-Kantianism, a fact which obviously refers us to his predecessors and mentors, yet it remains a mystery what the theoretical grounds are for a change in his position, or a “different arrangement of focal points” in the post-war era. He then realigned his theory. From then on, he associated the notion of law with values which were not relative. With regard to the lawmorality relation (whether and under what circumstances positive law may not be applied if it infringes the basic moral principles), Radbruch’s response does not contradict Acquinas’ reply. It seems justified to ask whether Neo-Kantianism still plays any constructive role. With due respect for interpretations of Radbruch’s formula created to date, the presented article attempts an analysis from a different perspective. This Christian perspective, particularly in the context of Cathrein’s views, constitutes the object of the presented study.
- ItemGodność człowieka w orzecznictwie polskiego Trybunału Konstytucyjnego(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2005) Potrzeszcz, JadwigaThe paper analyses and interprets the Polish Constitutional Tribunal judicature in order to examine how the concept of human dignity is understood by this court, and what normative contents are included in the concept of human dignity, as it is formed by the Tribunal judicature. According to the Tribunal, the concept of human dignity must be understood in two aspects: on the one hand, dignity is an ontic value, innate and indispensable; on the other hand, it is a value which people acquire in the course of their lives, and may lose it through their own or others' acts. This distinction has an enormous impact on the practice of the Constitutional Tribunal judicature.

The reason why we need a closer analysis of these concepts is justified by the fact that they were used in the debate on the Polish Constitutional Tribunal. The positivistic conception of law, despite different varieties of positivism, is fairly well-known in Poland. Now, the non-positivistic conceptions appeared relatively recently. It is worth our attention, for it may become an alternative for the eternal conflict between the two opposing positions: legal positivism and iusnaturalism.

- ItemSprawiedliwość a celowość w prawie(Towarzystwo Naukowe KUL, Katolicki Uniwersytet Lubelski Jana Pawła II, 2004) Potrzeszcz, JadwigaIn the article an attempt is undertaken at defining mutual relations of justice and purposefulness, as the values that form the idea of law. The conception of the idea of law was worked out mainly by the German philosophy of law, and especially by G. Radbruch and A. Kaufmann. In the idea of law G. Radbruch distinguished three elements: justice, purposefulness and reliability of law. Justice is a formal principle whose essence is equality. It just defines the form of law, requiring that the equal should be treated equally and the unequal differently in an adequate way. To complement this principle purposefulness is necessary, which is a material principle defining the contents of law. However, since it is connected with relativism and controversies may originate of the political-worldview nature concerning the contents of law, also the principle of reliability of law is necessary that can put an end to these controversies and bring about legal peace, securing the binding force for the positive law. Between these three elements of the idea of law, according to Radbuch, there is a relation of mutual exclusion. A. Kaufmann developed the theory of the idea of law. His point of departure was the fact that as equality is the essence of justice, then equality itself is not the whole of justice. There are other tendencies beside it, namely, purposefulness and security of law. He identified the idea of law with a broadly understood justice that may be considered in three aspects: in the aspect of justice as equality, in the aspect of justice as purposefulness and in the aspect of justice as a factor giving security of law.

- ItemUniwersalna gramatyka moralności i prawa(Fundacja „Utriusque Iuris”, Uniwersytet Jagielloński, 2011) Potrzeszcz, JadwigaThe universal grammar of morals and law is an original scientific proposition which can be the alternative to the relativist views in theory and philosophy of law. The authors of this conception are two scholars, lawyers and philosophers: Matthias Mahlmann – professor of Zurich University and John Mikhail – professor of Georgetown University in Washington. Their scientific fields involve the cognitive science, the research on human brain and the theory of human spirit which they learned in Massachusetts Institute of Technology in Cambridge (MIT). The greatest influence on their scientific development had a world-known linguists – Noam Chomsky, the author of the universal grammar and the researcher of a human nature and the functioning of a human spirit. M. Mahlmann and J. Mikhail noticed possibility of applying his results in the field of morals and law. This article tries to show the Polish reader the concept of universal grammar of morals and law. It seems that we are confronted with a new trend in the research of morals and law. This research develops in the field of cognitive science as one of tree branches, namely: 1) evolutional psychology, 2) neuroethical emotivism, 3) universal grammar of morals and law (mentalist ethics and theory of law). Although cognitive sciences are oft reduced to determinist naturalism, in the mind of the authors of the universal grammar of morals and law, it must not be the necessary rule. As the evidence of that can be their theory. According to them, human spirit is functioning as the manifestation of human brain.
