Teoria i praktyka(Akademia Wymiaru Sprawiedliwości, 2023) Potrzeszcz, JadwigaProblematyka aksjologii prawa, podjęta w niniejszej rozprawie, obejmuje wielość szczegółowych zagadnień, możliwych do zidentyfikowania poprzez przyjęcie dwóch perspektyw: 1) prawo jako wartość, 2) wartości w prawie. Rozważając zagadnienie prawa rozumianego jako wartości szczególnie istotnej w życiu społecznym człowieka, należało zaakcentować, że w tym ujęciu chodzi o sprawiedliwe prawo stanowione. Aby prawo stanowione było sprawiedliwe, nie może powstawać w rezultacie działania jedynie prawotwórczej woli podmiotu kompetentnego we wspólnocie do tworzenia prawa. Innymi słowy, nieco upraszczając, nieakceptowalna jest – tkwiąca korzeniami w teorii Thomasa Hobbesa – paremia: non veritas, sed auctoritas facit legem. Sprawiedliwość prawa pozytywnego nie jest zależna od arbitralnej woli prawodawcy, lecz od tego, czy prawodawca uwzględni w procesie tworzenia prawa, prawnonaturalne, ponadpozytywne dyrektywy i uwarunkowania. Zatem prawo sprawiedliwe powstaje w drodze racjonalnego namysłu nad rzeczywistością będącą przedmiotem regulacji prawnej. Prawo we właściwym sensie jest „rozporządzeniem rozumu dla dobra wspólnego”, jak to wyraził św. Tomasz z Akwinu. Jedynie takie sprawiedliwe prawo może być zabezpieczeniem przed samowolą władzy, np. władzy państwowej, może gwarantować adresatom bezpieczeństwo prawne. W moim przekonaniu, jedynie takie prawo można uznać za integralny element zasad, wyrażonych jako: zasada państwa prawa czy zasada praworządności. Właściwy sens tych zasad poprzedzony jest przynajmniej milczącym założeniem, że chodzi o sprawiedliwe prawo pozytywne, o ile oczywiście zaistnieje sytuacja namysłu nad sensem tak często dzisiaj stosowanych wyrażeń: praworządność oraz państwo prawa. Nie mogliśmy jednak poprzestać na ogólnym, upraszczającym stwierdzeniu, że prawo pozytywne powinno być sprawiedliwe. Twierdzenie to stanowiło punkt wyjścia do wskazania, jakie są wyznaczniki sprawiedliwego prawa. Rozdział pierwszy niniejszej rozprawy został w całości poświęcony tej problematyce. Należało zaakcentować na wstępie, że problem sprawiedliwości prawa dotyczy wyłącznie prawa pozytywnego. Wynika to wprost z tego, że prawo naturalne jest z samej swej istoty sprawiedliwe. Prawo naturalne wyznacza właściwą perspektywę oceny sprawiedliwości prawa stanowionego. Determinanty sprawiedliwego prawa możliwe są do zidentyfikowania w takim samym stopniu, w jakim stopniu człowiek posiada zdolność do odczytania zasad prawa naturalnego za pomocą rozumu praktycznego lub zmysłu moralnego. Przyjęta perspektywa prawnonaturalna umożliwiła wskazanie, jakie konkretnie wymagania powinien uwzględnić prawodawca, aby tworzone przez niego prawo było prawem sprawiedliwym. Do determinantów sprawiedliwego prawa zostały zaliczone następujące: godność człowieka, dobro wspólne, natura rzeczy, właściwe określenie zakresu kompetencji prawodawcy oraz wyznaczenie granic jego swobody w określaniu treści prawa, a także związane z tą kwestią respektowanie przez prawodawcę zasady równości i proporcjonalności w ograniczaniu praw i wolności człowieka. Wskazane determinanty sprawiedliwego prawa stanowią jedynie punkty orientacyjne dla prawodawcy, nie zaś gotową receptę gwarantującą osiągnięcie sukcesu w obszarze sprawiedliwości. Każdorazowo w procesie tworzenia konkretnych unormowań prawodawca powinien uwzględnić te orientacyjne punkty odniesienia i samodzielnie za pomocą rozumu praktycznego ustalić, co w kontekście danego przedmiotu regulacji prawnej wynika z tych wskazówek. Zakłada się, że prawodawca jest zdolny odczytać za pomocą własnej kognitywnej możności, jakie prawnonaturalne tytuły powinny zostać uwzględnione w treści prawa pozytywnego. Te prawononaturalne tytuły mają przede wszystkim swe źródło w przyrodzonej i niezbywalnej godności człowieka oraz konieczności uwzględnienia, że wszelkie regulacje prawne powinny być ostatecznie ukierunkowane na urzeczywistnianie dobra wspólnego. Pomocna w tym zakresie jest również analiza przez prawodawcę, jakie wskazówki płyną dla niego z natury (istoty) przedmiotu regulacji prawnej, innymi słowy chodzi o uwzględnienie natury rzeczy jako faktora z obszaru faktyczności. W kolejnym etapie prawodawca na gruncie wniosków praktycznych sformułowanych w toku rozważań uwzględniających wartość godności człowieka, wartość dobra wspólnego oraz natury rzeczy, powinien prawidłowo zidentyfikować swoje kompetencje oraz granice swobody w określaniu treści prawa. W szczególności powinien kierować się zasadą równości mającą swą podstawę i uzasadnienie w przyrodzonej i niezbywalnej godności człowieka, oraz proporcjonalnie rozkładać ciężary, i ograniczenia wolności i praw. Wszelkie ograniczenia wolności i praw muszą być proporcjonalne do wagi celu, któremu dane unormowanie ma służyć. Ostatecznie jednak wszystkie cele polityki państwa powinny w dalszej perspektywie służyć realizacji dobra wspólnego, którego co do zasady nie powinno się przeciwstawiać dobru każdego człowieka. Rozważając zagadnienie aksjologii prawa z drugiej perspektywy, a mianowicie w centrum uwagi stawiając problematykę wartości w prawie, trzeba najpierw uwzględnić dwie fundamentalne wartości, którymi są: sprawiedliwość i bezpieczeństwo prawne. Dość utrwalony jest pogląd o antynomiczności tych wartości za sprawą Gustawa Radbrucha, który taką relację określił w ramach idei prawa. Relacje tych dwu fundamentalnych wartości w prawie mogą być różnie postrzegane w zależności od tego, jak konkretnie pojmowana jest sprawiedliwość oraz bezpieczeństwo prawne. Przyjęte w niniejszej rozprawie pojmowanie bezpieczeństwa prawnego nie stawia tego pojęcia w relacji przeciwstawności do sprawiedliwości. Niemniej jednak relacja obu tych pojęć jest złożona. W punkcie wyjścia przyjęte zostało ustalenie, że zarówno sprawiedliwość, jak i bezpieczeństwo prawne mają swe źródło w prawie naturalnym. To prawnonaturalne roszczenie do urzeczywistnienia sprawiedliwości w prawie oraz urzeczywistnienia bezpieczeństwa prawnego w konkretnym porządku prawnym może być zrealizowane w różnym stopniu, w zależności od konkretnych uwarunkowań społeczno-gospodarczych i politycznych. Jednakże jedynym dostępnym i najlepszym środkiem realizacji sprawiedliwości oraz bezpieczeństwa prawnego jest prawo stanowione. Na postawione we wstępie pytanie o wpływ stopnia urzeczywistnienia sprawiedliwości prawa na stopień urzeczywistnienia bezpieczeństwa prawnego należy odpowiedzieć, że im bardziej prawo jest sprawiedliwe, w tym większym stopniu urzeczywistnione jest bezpieczeństwo prawne. A im bardziej prawo jest niesprawiedliwe, w tym większym stopniu traci przymiot bycia adekwatnym środkiem urzeczywistnienia bezpieczeństwa prawnego. Te dwie zasadnicze wartości znajdują się w relacji współdziałania i umacniania. Zatem konieczne jest dążenie do osiągania jak najwyższego poziomu sprawiedliwości prawa, ponieważ to przekłada się wprost na osiąganie wyższego poziomu bezpieczeństwa prawnego. Natomiast jeśli prawo byłoby niesprawiedliwe w tak wielkim stopniu, że przekroczony zostałby próg możliwej do zniesienia dozy niesprawiedliwości prawa, wówczas nie można byłoby oczekiwać bezpieczeństwa prawnego ze strony takiego „prawa”, czy raczej właściwie „ustawowego bezprawia”. W takiej sytuacji, to samo prawo pozytywne stałoby się zagrożeniem dla człowieka, nie dając mu żadnego bezpieczeństwa prawnego. Należy to jeszcze raz zaakcentować, że w momencie krytycznym, gdy ze względu na ekstremalną niesprawiedliwość prawo traci naturę prawa, traci tym samym swój walor bycia środkiem gwarancji bezpieczeństwa prawnego, a wręcz może nawet zagrażać dobrom życiowym i interesom człowieka. Wówczas funkcję gwarancyjną musi z konieczności przejąć rozum praktyczny (głos sumienia), który wskaże człowiekowi, jak odpowiednio do sytuacji należy się zachować. Sprawiedliwość prawa stanowionego jest bezpośrednio uzależniona od uszanowania w prawie godności człowieka jako wartości absolutnej każdej istoty ludzkiej. Człowiek ze względu na swoją społeczną naturę żyje i realizuje się we wspólnocie. Osiąga swoją doskonałość (tj. pełny rozwój tkwiących w nim potencjalności) we współpracy z innymi ludźmi. W ten sposób realizuje się dobro wspólne. Dobro wspólne jest wartością osiąganą w relacjach społecznych, w społecznym współdziałaniu. W takim klasycznym, teoretycznym ujęciu pomiędzy dobrem wspólnym a godnością człowieka panuje harmonia. Aby zweryfikować tę teorię w praktyce, osobna części niniejszej rozprawy została poświęcona analizie całego dotychczasowego orzecznictwa polskiego Trybunału Konstytucyjnego, który na przestrzeni ponad trzech dekad wypowiadał się na temat rozumienia tych wartości i zasad konstytucyjnych. W szczególności po wejściu w życia aktualnie obowiązującej Konstytucji RP, w której wprost zostały sformułowane zasady dobra wspólnego i godności człowieka. Trybunał Konstytucyjny w swoich wypowiedziach orzeczniczych wielokrotnie dał wyraz uznaniu wartości godności człowieka i wartości dobra wspólnego za najwyższe konstytucyjne wartości w polskim porządku prawnym. Wartości te wpływają na cały porządek prawny na poziomie podkonstytucyjnych aktów normatywnych. Zasadniczo wartości te nie powinny być względem siebie antagonistyczne, lecz realizacja obu ma służyć ostatecznie rozwojowi człowieka w jego życiu we wspólnocie. Jednakże w razie zaistnienia jednak sytuacji konfliktu pomiędzy tymi wartościami Trybunał Konstytucyjny daje pierwszeństwo ochronie przyrodzonej i niezbywalnej godności człowieka. The issue of the axiology of law addressed in the present dissertation encompasses a multiplicity of specific problems, which are identifiable by adopting two perspectives: 1) law as a value, 2) values in law. When considering the issue of law as a value of particular relevance to human social life, it is important to emphasise that this approach concerns fair (just) positive law. Thus, in order to be fair, positive law (statutory/statute law) cannot be the outcome of the mere law-making will of an entity competent in the community to create law. In other words, slightly simplifying, the legal maxim rooted in the theory of Thomas Hobbes - non veritas, sed auctoritas facit legem - is unacceptable. The justice of positive law is not dependent on the arbitrary will of the legislator, but on whether the legislator, in the process of law-making, takes into account natural law, supra-positive directives and determinants. Therefore, fair law is created through rational reflection upon the reality that is the object of legal regulation. Law in its proper sense is “an ordinance of reason for the common good”, as St Thomas Aquinas expressed it. Only such fair law may provide a safeguard against arbitrary authority, e.g. state authority, and may guarantee legal security to its addressees. In my view, only such law may be regarded as an integral element of the principle expressed as ‘the Rule of Law’. The correct sense of this principle is preceded by at least the implicit assumption that it concerns fair positive law, provided that a reflection on the meaning of the so frequently used expression today ‘the Rule of Law’ actually takes place. However, we cannot stop at the general simplistic statement that positive law should be fair. This claim was the starting point for indicating the determinants of fair law. The first chapter of the present dissertation was devoted entirely to this issue. It should be emphasised at the outset that the issue of the justice of law concerns only positive law. This follows directly from the fact that natural law is inherently fair. Natural law determines the proper perspective for assessing the fairness of positive law. The determinants of fair law are identifiable to the same extent that a human being has the capacity to interpret the principles of natural law by means of practical reason or the moral sense. The adopted legal-natural perspective allowed indicating specific requirements that the legislator should take into account to ensure that the law it creates is fair law. The determinants of fair law include the following: human dignity, the common good, the nature of things, the proper definition of the scope of the legislator’s competence as well as the setting of the limits of its freedom in determining the content of the law, and the related respect for the principles of equality and proportionality in restricting human rights and freedoms by the legislator. The indicated determinants of fair law are only landmarks for the legislator, not a ready solution guaranteeing success in the field of justice. Each time in the process of drafting specific norms, the legislator should take into account these landmarks and, by means of practical reason autonomously, determine what, in the context of the respective object of legal regulation, results from the landmarks. It is assumed that the legislator is capable of reading by means of its own cognitive powers which natural law entitlements should be included in the content of positive law. These natural law entitlements primarily have their origin in the inherent and inalienable dignity of the human being as well as in the necessity to consider that any legal regulation should ultimately be directed towards the implementation of the common good. In this regard, it is also useful for the legislator to analyse which guidelines stem from the nature (essence) of the subject matter of the legal regulation, in other words to consider the nature of things as a factor from the field of reality. In the next stage, the legislator, on the basis of the practical conclusions formulated in the course of considerations involving the value of human dignity, the value of the common good and the nature of things, should correctly identify its competence and the limits of its freedom in determining the content of the law. In particular, the legislator should be guided by the principle of equality having its basis and rationale in the inherent and inalienable dignity of the human being, and proportionately distribute the burdens, as well as the limitations of freedoms and rights. Any restrictions on freedoms and rights must be proportionate to the gravity of the objective which the regulation is intended to serve. Ultimately, however, all state policy objectives should in the long term serve the common good, which in principle should not be opposed to the welfare of each individual. When considering the issue of the axiology of law from a second perspective, namely focusing on the issue of values in law, first it is necessary to consider two fundamental values, which are justice and legal security. The view of the antinomy of these values is fairly well established due to the formula of Gustav Radbruch, who defined such a relationship within the idea of law. The relationship of these two fundamental values in law may be perceived differently depending on the particular understanding of justice and legal security. The understanding of legal security adopted in the present dissertation does not juxtapose this concept with justice. Nevertheless, the relationship of the two concepts is complex. As a starting point, it is accepted that both justice and legal security have their origin in natural law. This natural-law claim to realise justice in law and to realise legal security in a particular legal order may be fulfilled to varying degrees, depending on the specific socio-economic and political circumstances. However, the only available and best means of achieving justice and legal security is positive law (statutory/statute law). The question posed in the introduction as to the effect of the degree to which the fairness of the law is realised on the degree to which legal security is realised must be answered as follows: The more the law is fair (just), the more legal security is realised. And the more the law is unjust, the more it loses the attribute of being adequate means of the realisation of legal security. These two fundamental values are in a relationship of interaction and enhancement. Thus, it is necessary to seek to achieve the highest possible level of fairness of the law, as this directly results in achieving a higher level of legal security. Whereas, if the law were unfair to such an extent that the threshold of a tolerable degree of injustice of the law was exceeded, then no legal security could be expected from such ‘law’, or actually ‘statutory lawlessness’. Under such circumstances, the positive law itself would become a threat to human beings without providing them with any legal security. It should be emphasised once again that at the critical moment, when, due to extreme injustice, the law loses its legal nature, it thus loses its value as a means of safeguarding legal security, and may even endanger the welfare and interests of the human being. Then, the guarantee function necessarily must be taken over by practical reason (the voice of conscience), which will indicate the person the proper way to act, according to the particular situation. The fairness (justice) of statutory law depends directly on the respect in law for human dignity as an absolute value of every human being. A human being, due to his or her social nature, lives and finds the fulfilment in a community. He or she reaches the perfection (i.e. the full development of the inherent potentialities) in cooperation with other people. Thus, the common good, which is the value achieved in social relations and interaction, is realised. There is harmony between the common good and human dignity in such a classical, theoretical approach. In order to verify this theory in practice, a separate part of the present dissertation is devoted to an analysis of the entire previous jurisprudence of the Polish Constitutional Tribunal, which, over the course of more than three decades, has commented on the understanding of the above constitutional values and principles. In particular, after the entry into force of the current Constitution of the Republic of Poland, in which the principles of the common good and human dignity were explicitly worded. The Constitutional Tribunal, in its judicial statements, has repeatedly expressed its recognition of the value of human dignity and the value of the common good as the highest constitutional values in the Polish legal order. These values influence the entire legal order at the level of sub-constitutional normative acts. In principle, these values should not be mutually antagonistic, but the realisation of both should ultimately serve the human development in his or her life in the community. Nevertheless, in the event of conflict between these values, the Constitutional Tribunal gives priority to the protection of the inherent and inalienable dignity of the human being.

Jej ochronę zapewniają w szczególności umowy międzynarodowe, które przyjęto w celu zabezpieczenia ludzkości przed powtórzeniem krwawej hekatomby II wojny światowej, której głównych przyczyn słusznie upatrywano w braku należnego poszanowania dla przyrodzonej godności człowieka i jego niezbywalnych praw. Aktualność oraz praktyczna doniosłość problematyki wolności myśli, sumienia i wyznania/religii zdecydowały o poświęceniu jej XI Ogólnopolskiego Sympozjum Prawa Wyznaniowego, połączonego ze Zjazdem Katedr, Zakładów i Wykładowców Prawa Wyznaniowego. Spotkanie to zostało zorganizowane przez Katedrę Prawa Wyznaniowego Katolickiego Uniwersytetu Lubelskiego Jana Pawła II oraz Polskie Towarzystwo Prawa Wyznaniowego i odbyło się w Lublinie w dniach 15-16 maja 2014 r. Program sympozjum objął blisko 40 referatów, których wygłoszenia podjęli się przedstawiciele niemal wszystkich ośrodków nauki prawa wyznaniowego w Polsce. Niniejsza publikacja stanowi pokłosie tego sympozjum, a na jej zawartość składają się opracowania, które – na bazie wygłoszonych wówczas referatów – zostały przygotowane przez większość prelegentów.

Jednocześnie, istnienie porządku prawnego i ładu moralnego jest warunkiem sine qua non dla zaistnienia odpowiedzialności. Nie bez znaczenia przedstawiciele doktryny podkreślają, że człowiek staje się odpowiedzialny dopiero wówczas, gdy jest w stanie do bycia zdolnym do zrozumienia ratio danego porządku normatywnego i społecznego, a następnie do wyrażenia wobec niego swojej postawy. Bez wątpienia, na co w pracy „Osoba i czyn” zwracał uwagę Karol Wojtyła, odpowiedzialność wiąże się z osobowym statusem bytu ludzkiego, jego postawą i działaniem. Są zatem sytuacje, w których człowiek, nie tylko może, ale i musi przyjąć na siebie tę odpowiedzialność, z drugiej jednak strony normy prawa stanowionego określają przesłanki oraz stany faktyczne i prawne, w których człowiek i nie może ponosić odpowiedzialności. Człowiek winien być ponadto świadomy w momencie dokonywania danego czynu i posiadać normalne zdolności do rozpoznawania sytuacji, w której się znalazł. Celem publikacji jest ukazanie, jak widać, wielu aspektów tej ludzkiej odpowiedzialności, przy poszanowaniu wszelkich należnych człowiekowi praw, a wynikających z przyrodzonej godności osoby ludzkiej. Podział i systematyka rozdziałów jest rezultatem wieloaspektowego, a niekiedy interdyscyplinarnego ujęcia analizowanych zjawisk realizowanych przez młodych badaczy, którzy stawiając pierwsze kroki na płaszczyźnie naukowej, nie wahają się jedna stawiać odważnych pytań. Poza zasadniczym stricte eksplanacyjnym celem opracowania inicjatorom powstania niniejszej publikacji towarzyszyła także chęć integracji środowisk młodych naukowców będących na początku swojej kariery akademickiej, jak również zogniskowania forum wymiany myśli i poglądów środowiska doktoranckiego na temat istoty regulacji w codziennym życiu człowieka.
- ItemDekrety reformatorskie z wizytacji kanonicznych przeprowadzonych przez Biskupa Tarnowskiego Jerzego Ablewicza(Wydawnictwo KUL, 2022) Paweł LewandowskiPrzedmiotem niniejszego materiału źródłowego opatrzonego aparatem krytycznym są 152 dekrety reformatorskie z wizytacji kanonicznych przeprowadzonych przez Biskupa Tarnowskiego Jerzego Ablewicza. Opracowanie jest efektem usługi badawczej obejmującej kwerendę archiwalną wykonaną w Archiwum Diecezjalnym im. Arcybiskupa Jerzego Ablewicza w Tarnowie. Celem podjętego działania jest nie tylko trwałe zachowanie spuścizny Biskupa Tarnowskiego Jerzego Ablewicza, ale także wyrażenie wdzięczności Pasterzowi ofiarnie służącemu diecezjanom w latach 1962-1990. W przedłożonej edycji zawarto, ułożone chronologicznie, wyłącznie dekrety reformatorskie z wizytacji kanonicznych przeprowadzonych osobiście przez abpa Ablewicza, chociaż należy zauważyć, że we wspomnianych latach w imieniu i z upoważnienia Biskupa Tarnowskiego parafie wizytowali także biskupi pomocniczy: Michał Blecharczyk, Karol Pękala, Piotr Bednarczyk, Józef Gucwa i Władysław Bobowski. Przygotowywane przez nich dekrety reformatorskie były drukowane na osobistym papierze Biskupa Tarnowskiego i podpisywane przez samego abpa Ablewicza. W analizowanym okresie zwizytowanych zostało 113 dekanatów. Biskup Tarnowski osobiście zwizytował w całości lub części 25 spośród nich. Materiał źródłowy opatrzony aparatem krytycznym został ubogacony częścią aneksową, w której znajdują się: 1. Wykaz wizytacji kanonicznych przeprowadzonych przez Biskupa Tarnowskiego Jerzego Ablewicza ze szczegółowym wskazaniem dat wizytacji, parafii, dekanatów, duchownych wymienionych w dekretach reformatorskich oraz sygnatur Archiwum Diecezjalnego im. Arcybiskupa Jerzego Ablewicza w Tarnowie zastosowanych w zespole Wizytacje Kanoniczne; 2. Trzeci Synod Diecezji Tarnowskiej – instrukcja synodalna dotycząca przebiegu wizytacji kanonicznej. Opracowanie zawiera także wykazy: skrótów oraz bibliograficzny źródeł prawa i literatury. The subject of the present source material with a critical apparatus are 152 reform decrees from canonical visitations carried out by Jerzy Ablewicz, the Bishop of Tarnów. The study is the result of a research service involving an archival search conducted in the Diocese Archive Archbishop Jerzy Ablewicz in Tarnów. The aim of the undertaking is not only to permanently preserve the legacy of Jerzy Ablewicz, the Bishop of Tarnów, but also to express gratitude to the Shepherd who sacrificially served the diocesan in the years 1962-1990. The presented edition contains, arranged chronologically, only the reform decrees from the canonical visitations carried out personally by Archbishop Ablewicz, although it should be noted that in the years mentioned above, in the name and on the authority of the Bishop of Tarnów, parishes were also visited by auxiliary bishops: Michał Blecharczyk, Karol Pękala, Piotr Bednarczyk, Józef Gucwa and Władysław Bobowski. The reform decrees prepared by them were printed on the personal paper of the Bishop of Tarnów and signed by Archbishop Ablewicz himself. During the analysed period, 113 vicariates forane were visited. The Bishop of Tarnów personally visited all or part of 25 of them. The source material provided with critical apparatus has been enriched by an annex part, which includes: 1. List of canonical visitations carried out by Jerzy Ablewicz, the Bishop of Tarnów with a detailed indication of the dates of the visitations, parishes, vicariates forane, clergy mentioned in the reform decrees and the signatures of the Diocese Archive Archbishop Jerzy Ablewicz in Tarnów applied in the Canonical Visitations unit; 2. List of clergy mentioned in the reform decrees from the canonical visitations conducted by Jerzy Ablewicz, the Bishop of Tarnów with indication of working numbers of reform decrees, signatures in the units: Personal Files of Priests or Personal Files of Priests Working Outside the Diocese and bibliographic records of posthumous biographies; 3. Visitation questionnaire (used until 1968); 4. Visitation questionnaire (used since 1969); 5. Third Synod of the Diocese of Tarnów – synodal statutes; 6. The dissertation adopted the thesis: The right to decent support is included in the catalog of fundamental rights due to every human being. Therefore, it is also entitled to diocesan presbyters so that they can properly fulfill their priestly vocation. This right was proclaimed by the legislator in can. 281, and also normalized the means of realizing the entitlement due to diocesan presbyters and obliged the particular legislators to specify it. The monograph sought answers to the following questions: what are the grounds of the law of diocesan presbyters for decent support; are these grounds legally binding, i.e. whether the obligation to exercise this right by other entities is correlated with the right of presbyters; what should be understood by ‘decent support’; what elements make up the right to decent support; how is this right implemented; whether the means of implementing this right indicated by the legislator are sufficient to secure the proper support of diocesan presbyters; how the right to decent support is implemented in the Polish particular legislation, i.e. whether the means of its implementation find practical application in the Church in Poland; is the system of decent support of diocesan presbyters in Poland homogeneous and sufficient? The issues raised in the monograph were carried out in three chapters, extended into smaller thematic units, preceded by a list of abbreviations and an introduction. Chapter I, which is an introduction to the subject, contains an explanation of the concepts of ‘diocesan presbyter’ and ‘decent support’, necessary for further analysis. After their exegesis, the theological and legal foundations for the right to support presbyters were shown. Chapter II addresses the problem of decent support of diocesan presbyters according to the Code of Canon Law of 1983. First, the entities obliged to care for the proper implementation of the presbyteral rights, including the faithful Christians and the diocesan bishop, were elaborated and the rights of presbyters arising from the ratio of incardination and temporary service in another particular Church were clarified. In the subsequent part of the chapter, the following issues were explored: call to simplicity of life, forms of decent support of presbyters (including: the offerings given for the celebration of Mass, iura stolae, remuneration for a given office or task and funds for the support of clergy as well as funds for the social security of clergy), regulation of inheritance property due to death. The legal basis for protecting and defending the right to decent support has also been indicated. The analysis of the decent support of diocesan presbyters according to the Code of Canon Law of 1983, carried out in Chapter II, allowed us to take up the same issue in Chapter III according to Polish particular legislation. The structure of the chapter corresponds to the previous one, however, in order to present the forms of decent support of presbyters, the following were included: offerings given for the celebration of Mass, iura stolae, offerings given due to pastoral Christmas visit, All Souls Day offerings, remuneration for a given office or task, other income, housing, meals and funds for the support of clergy and social security of clergy. The conclusion includes the reasumption of the results of analyzes undertaken in the individual chapters and the conclusions de lege lata and de lege ferenda. The dissertation is culminated by an annex containing a Polish translation of the Decretum de recursu super congruentia inter legem particularem et normam codicialem of the Pontifical Council for Legislative Texts, a bibliographic list of sources of law and literature, a summary of the dissertation in English and a list of contents in English and Polish.

Their importance is particularly evident in the communication process between people, to express and exchange views, in teaching and in obtaining and transmitting information. The Church shares a vision for the media, as evidenced by the documents: the Second Vatican Council, the Congregation for Bishops, the Congregation for the Doctrine of the Faith, the Congregation for Catholic Education and the Pontifical Council for Social Communications, as well as the papal teaching. In the Code of Canon Law of 1983 the church legislature devotes eleven canons (822-832) that make up the Title IV of De instrumentis communicationis socialis et in specie de libris of Book III De Ecclesiae munere docendi, to social communication. In an indirect way, the legislature refers to social communication in can. 666 belonging to Book II of De Populo Dei; can. 747, 761, 772, 779, 804 belonging to Book III De Ecclesiae munere docendi; can. 1063 belonging to Book IV of De Ecclesiae munere sanctificandi as well as can. 1369 belonging to Book VI De sanctionibus in Ecclesia. Among the numerous post-code Polish legislations, the issue of the competence of the diocesan bishop concerning social communication is defined by twenty-four particularistic and diocesan councils and the Standards of the Conference of the Polish Episcopate concerning the requirements for clerics and religious and communicating the Christian doctrine in radio and television. The Code of Canon Law of 1983 and the post-code Polish particular legislation grant the diocesan bishop wide ranging competence concerning the media. The core competence of the diocesan bishop in the analyzed material is the use of the instruments of social communication and the spreading of the Gospel through them. For this reason, he is obliged to deepen his knowledge concerning new communication tools and developing skills in using them. Within his competence there is also the instructing and directing of the faithful so that – through means of social communication – they may progress in attaining perfection of self and loved ones. The diocesan bishop should sensibilize the obligation to cooperate in building up the Church using the new tools of communication. Social communication, although they play an important role, can not replace personal proclamations of the Word of God. An important competence of the diocesan bishop is to ensure the purity of the truths of faith and morals on the area of the particular Church, entrusted to his care. This is fulfilled through the exercise of his competence: he is to take care that faith and morals of the faithful are not harmed by the written word or the use of instruments of social communication; he is to require that which is to be issued by the faithful in writing and applies to faith or morals be presented for prior assessment; and to reject any writings which harm correct faith or morals. In fulfilling the tasks of ensuring the integrity of the truths of faith and morals the diocesan bishop is therefore competent to: consenting to the fact, that instruments of social communication that are subject to him, in their name use the term „Catholic”; establish ecclesiastical assistants of Catholic media; appoint censors to evaluate publications and religious programs; giving authorisation to issue works in the area of faith and morals; express consent for the clerics and religious for permanent or temporary cooperation with radio stations or television stations and publishing in newspapers, magazines or periodicals which clearly are attacking religion or good morals. The competence of the diocesan bishop also includes concern for the Catholic instruments of social communication. He is entitled to: appoint and dissolve Catholic media; approve and amend the statutes by which they are guided; establish and dismiss those responsible for Catholic instruments of social communication; and have concern for the finances of the Catholic media. In the competence of the diocesan bishop, there is also the appointing of entities authorized to represent the particular Church in the media. The diocesan bishop also defines the range of rights to these entities. In the event of a serious breach of rules concerning the presence of the clerics and religious, and preaching the dogmas of the Church in the media, the diocesan bishop is competent to mete out administrative and penal sanctions against those who harm the faith or good morals. The aim of this action is to lead to repentance those, who violate the law, to protect the spiritual good of the faithful and the desire to preserve the unity of the Church. In conclusion, we need to state that there is coherence between the Code of Canon Law of 1983 and the post-code Polish particular legislation in the matter of the competence of the diocesan bishop concerning the instruments of social communication.

Interdyscyplinarne badania zrealizowano w paradygmacie badawczym J. Cardina, obejmującym trzy etapy naukowej eksploracji: widzieć – ocenić – działać. Na pierwszym etapie badań (widzieć) poddano analizie komunikację Kościoła w czterech perspektywach: prawnej, pragmalingwistycznej, medialnej i socjologicznej – w tych ujęciach sformułowano wnioski i rekomendacje (rozdziały I-IV). Na podstawie uzyskanych interdyscyplinarnych wyników badań zrealizowano drugą część etapu badawczego (ocenić – działać) w perspektywie teologicznopastoralnej. Stosując metodę analizy krytycznej i wnioskowania, dokonano syntetycznej oceny komunikacji Kościoła w hermeneutycznym kluczu trzech podstawowych funkcji Kościoła: prorockiej, kultycznej i pasterskiej. Procedura ta pozwoliła zamknąć trzeci etap badawczy rekomendacjami teologicznopastoralnymi i duszpasterskimi adresowanych do Kościoła katolickiego w Polsce (rozdział V Raportu). Cechą znamienną realizacji w okresie pierwszej fali COVID-19 zarówno funkcji prorockiej, jak i kultycznej była mediatyzacja przepowiadania i sprawowania sakramentów, szczególnie Eucharystii. Przyniosło to nowe sposoby uczestniczenia w kulcie, w liturgii, w sakramentach (Eucharystia, sakrament pokuty i pojednania) oraz zauważalny trend prywatyzacji wiary. Tym samym postawiło Kościół przed koniecznością poszukiwania nowych form duszpasterstwa.
- ItemKościół w publikacjach „Gazety Wyborczej” w czasie Wielkiego Jubileuszu Roku 2000(Poligrafia Redemptorystów, 2017) Lewandowski, Paweł„Gazeta Wyborcza” is considered to be one of the most influential and opinion-generating Polish newspapers. Since its inception, it regularly publishes articles on topics closely related to the Church. During the Great Jubilee of the Year 2000 „Gazeta Wyborcza” published 677 texts on the Church, its pastoral leaders and faithful, texts broaching issues of ethics and Christian morality. In the press material published in „Gazeta Wyborcza” in the Year of the Great Jubilee a vision of a divided and dissented Church, is clearly drawn. The journal editors recognize lack of internal unity among the clergy, as well as between the clergy and the faithful. The editors, while emphasizing the alleged internal division of the Church, point to the need for dialogue with liberal mentality. Hence, the journalists create in the daily paper symbols of this dialogue, which are promoted by them, the so called „soft faces” of the Church. From the publications of „Gazeta Wyborcza” in the Year of the Great Jubilee, a vision of the Church emerges as a kind of sociological and specific political formation. To define this, the journal editors usually use terms such as monarchy, fortress, stronghold, world power, headquarters, department or federation. „Gazeta Wyborcza” is also known for its ingenuity in finding and vividly describing ecclesiastical sensations. Each revelation from the life of the Church and the people associated with it does not go unnoticed by the journalists and is reflected in numerous press reports, coverages and newspaper columns. It should be added that the „sensational” information often has no reflection in reality. Showing the scandals and sensationalism in the Church is an intentional activity and is designed to ridicule the clergy and to discourage the faithful in regard to the Church. The vision of Christian morality created by „Gazeta Wyborcza” is incompatible with the interpretation of the Magisterium of the Church. The journalists in their articles take up a fight with the Church – a teacher of Christian ethical principles, especially through the use of deliberate demoralization. According to the columnists, the most respected value should be tolerance. However, this „tolerance” is – in the opinion of the journal's editors – an abandonment of the defence of their professed principles, as well as not giving their view point concerning good and evil. In „Gazeta Wyborcza” we find praise for a culture that believes that in vitro fertilization, abortion and euthanasia are a sign of progress and a triumph of freedom. In the Year 2000, the journalists of „Gazeta Wyborcza” devoted many publications to propagating homosexual attitudes. The struggle with the Church of „Gazeta Wyborcza”, or – as it would probably be preferred by the editors of the journal – a fight for the liberalization of Polish Catholicism continues. The image of the Church and the vision of Christian morality created in „Gazeta Wyborcza” remains a tool of this struggle.

Rozważania o komunikacji opartej na kontekście(Towarzystwo Naukowe KUL, 2019) Kuncewicz, Dorota; Sokołowska, Ewa; Sobkowicz, Jolanta; Kuncewicz, DariuszThe Shannon-Weaver model of communication, which dates back to 1948, ranks surprisingly well - or rather its popularized version - in the social Sciences and humanities. This is evidenced for example by Roman Jakobson’s model of communication, which is classic in linguistics, as well as by numerous seminars and books that refer to this model and its derivatives as a benchmark and an ideal to strive for. However, once we take a look at Shannon’s article "A Mathematical Theory of Communication," published in The Bell System Technical Journal, doubts about the application of this model in interpersonal communication arise, and they seem justified and obvious. The vocabulary itself should make us highly cautious ("pair of wires, a coaxial cable, a band of radio frequencies, a beam of light"). There are clear indications that referring to the Shannon-Weaver model in interpersonal communication is either a misunderstanding or a proof of failure to understand the concept. Although researchers later made attempts to modify the model, the results cannot be considered very successful, as has been confirmed by a number of critical analyses for years present in the literature. The model's popularity and resistance to criticism, understood as being present in training and teaching despite a clearly critical assessment, thus seems to result not so much from the accuracy of the description as from its correspondence to man's dream of control and a simple view of reality, reduced to an orderly, categorized and simple system. The model’s assumptions that it is possible to have a perfect, precise, flawless and effective communication are in line with our disagreement to disability, weakness, or dependence; with our refusal to accept that our imperfection, intuitive-ness, emotionality or irrationality significantly determine our humanity. It is extremely difficult for us to face the fact that all the things we would gladly eliminate from our lives are those that not only allow us to survive and build a common part of the world with others, but often help us to live our lives more happily. If the premise we have formulated is correct, it will be necessary to reverse a vector in thinking about communication. Perhaps it is the complexity of communication - and not its simplicity, precision and schematicity - that makes communication possible. Maybe it is not the context of an utterance that determines its code, but on the contrary - the code has a supportive function in determining the contexts within which we communicate. And maybe we communicate not in spite of so-called communication disturbances, but thanks to them - thanks to so-called errors? Maybe communication is, above all, a long-term and strenuous process of building common contexts in conversations and social encounters, in other words building a common part of the world. In its assumptions, the mathematical model is consistent with the current socio-cultural trends, which do not value work or effort, but are based on the belief that you can get everything without doing anything or very little. Thus, these trends fit well and even dangerously strengthen solutions that do not foster, but rather hinder personal development. It is especially evident in the upbringing and educational contexts. Although there is quite a lot of talk about active listening, at the same time there are no requirements or expectations that the recipient should increase his/her vocabulary and that those who want to participate in social communication are obliged to know the language code at a certain level. Without so formulated a requirement and its enforcement, communication-oriented active listening can become a tool to perpetuate lack of communication. If each element of the code can be asked about and each can be considered incomprehensible, then the course of such "conversation" is reduced to absurdity. The virtually sole responsibility of the message sender relieves the message recipient from making any effort. Thus, the child is given tools to reject the responsibility for communication (adults should make themselves more precise), and which allow him/her to take on a role that does not belong to him/her -that of making adults accountable. And yet, almost every word can be shown as imprecise if its context is not taken or is only partially taken into account. This is not about balancing the responsibility of the child with that of the adult, but about the right to expect the child to put some effort into his/her development. This is the way to participate in interpersonal communication within the community in which he/she lives, while also respecting the voices ofhis/her ancestors. The mathematical model is not applicable in the field of counselling and psycho-therapy either. The mathematical model of communication would not accept the thesis that ambiguity, errors and distortions that occur, as well as the inability to achieve precision in defining meanings, make sense. Nor would it be acceptable to say that spouses communicate excellently when the therapist is convinced that they are making major communication errors. And indeed, such an assumption is helpful in the counselling and therapy of couples. It is helpful because it is the starting point for the therapist to learn the language the couple has developed for themselves. Without understanding this unique language, assistance is more difficult, sometimes only superficial. However, there is a certain contradiction or paradox in people. Although on the one hand we dream of simplicity and an easy-to-follow description pattern, at the same time we long for mystery, for touching something that overwhelms us - some-thing that is beyond our comprehension. Something that cannot be easily catalogued or arranged according to a defined scheme, something that escapes our control, but is intuitively perceived as important, and indeed extraordinary. The approach to con-text-based communication, proposed in this book, refers precisely to such a longing, and to such a relationship between an individual and the world that is reflected in language. Having this idea in mind, we developed a series of activities presented in the last part of the book. We conducted them among school children or students in order to draw their attention to the complexity of communication and to give them a chance to admire the language and its mystery, as well as to make them notice the importance of silence, which speaks, and the importance of the words which remain unspoken. At the same time, we wanted - by providing these activities - to give young people an opportunity to experience that "in order to set thoughts in motion, it is necessary to have contact with real art.’’

Do szczegółowych problemów poruszanych w pracy należą m.in. kryteria selekcji związków wyznaniowych dopuszczanych do rokowań, sposób prowadzenia negocjacji, specyfika procedury ustawodawczej znajdującej zastosowanie w odniesieniu do ustaw uchwalonych na podstawie porozumień, szczególne cechy tych ustaw oraz treść unormowań przyjętych w uzgodnieniu ze związkami wyznaniowymi i ich relacja do norm odnoszących się do grup religijnych, których sytuacja prawna nie została uregulowana w trybie dwustronnym.
