Their importance is particularly evident in the communication process between people, to express and exchange views, in teaching and in obtaining and transmitting information. The Church shares a vision for the media, as evidenced by the documents: the Second Vatican Council, the Congregation for Bishops, the Congregation for the Doctrine of the Faith, the Congregation for Catholic Education and the Pontifical Council for Social Communications, as well as the papal teaching. In the Code of Canon Law of 1983 the church legislature devotes eleven canons (822-832) that make up the Title IV of De instrumentis communicationis socialis et in specie de libris of Book III De Ecclesiae munere docendi, to social communication. In an indirect way, the legislature refers to social communication in can. 666 belonging to Book II of De Populo Dei; can. 747, 761, 772, 779, 804 belonging to Book III De Ecclesiae munere docendi; can. 1063 belonging to Book IV of De Ecclesiae munere sanctificandi as well as can. 1369 belonging to Book VI De sanctionibus in Ecclesia. Among the numerous post-code Polish legislations, the issue of the competence of the diocesan bishop concerning social communication is defined by twenty-four particularistic and diocesan councils and the Standards of the Conference of the Polish Episcopate concerning the requirements for clerics and religious and communicating the Christian doctrine in radio and television. The Code of Canon Law of 1983 and the post-code Polish particular legislation grant the diocesan bishop wide ranging competence concerning the media. The core competence of the diocesan bishop in the analyzed material is the use of the instruments of social communication and the spreading of the Gospel through them. For this reason, he is obliged to deepen his knowledge concerning new communication tools and developing skills in using them. Within his competence there is also the instructing and directing of the faithful so that – through means of social communication – they may progress in attaining perfection of self and loved ones. The diocesan bishop should sensibilize the obligation to cooperate in building up the Church using the new tools of communication. Social communication, although they play an important role, can not replace personal proclamations of the Word of God. An important competence of the diocesan bishop is to ensure the purity of the truths of faith and morals on the area of the particular Church, entrusted to his care. This is fulfilled through the exercise of his competence: he is to take care that faith and morals of the faithful are not harmed by the written word or the use of instruments of social communication; he is to require that which is to be issued by the faithful in writing and applies to faith or morals be presented for prior assessment; and to reject any writings which harm correct faith or morals. In fulfilling the tasks of ensuring the integrity of the truths of faith and morals the diocesan bishop is therefore competent to: consenting to the fact, that instruments of social communication that are subject to him, in their name use the term „Catholic”; establish ecclesiastical assistants of Catholic media; appoint censors to evaluate publications and religious programs; giving authorisation to issue works in the area of faith and morals; express consent for the clerics and religious for permanent or temporary cooperation with radio stations or television stations and publishing in newspapers, magazines or periodicals which clearly are attacking religion or good morals. The competence of the diocesan bishop also includes concern for the Catholic instruments of social communication. He is entitled to: appoint and dissolve Catholic media; approve and amend the statutes by which they are guided; establish and dismiss those responsible for Catholic instruments of social communication; and have concern for the finances of the Catholic media. In the competence of the diocesan bishop, there is also the appointing of entities authorized to represent the particular Church in the media. The diocesan bishop also defines the range of rights to these entities. In the event of a serious breach of rules concerning the presence of the clerics and religious, and preaching the dogmas of the Church in the media, the diocesan bishop is competent to mete out administrative and penal sanctions against those who harm the faith or good morals. The aim of this action is to lead to repentance those, who violate the law, to protect the spiritual good of the faithful and the desire to preserve the unity of the Church. In conclusion, we need to state that there is coherence between the Code of Canon Law of 1983 and the post-code Polish particular legislation in the matter of the competence of the diocesan bishop concerning the instruments of social communication.

Zgodnie z wolą ustrojodawcy relacje te mają być określane w trybie układowym. W odniesieniu do Kościoła Katolickiego zdecydowano o zastosowaniu umowy międzynarodowej, zawartej ze Stolicą Apostolską (art. 25 ust. 4). Ponadto postanowiono, że „stosunki między Rzecząpospolitą Polską a innymi kościołami oraz związkami wyznaniowymi określają ustawy uchwalone na podstawie umów zawartych przez Radę Ministrów z ich właściwymi przedstawicielami” (art. 25 ust. 5). Niniejsza publikacja stanowi głos w dyskusji dotyczącej zarówno teoretycznego znaczenia, jak i praktycznych implikacji art. 25 ust. 4-5 Konstytucji RP.
