- ItemTax Incentives for Food Donations – a General Overview(Wydawnictwo KUL, 2022) Burzec, Marcin; Kowalewska, EwaThe study analyses tax law regulations in force in Poland and in selected European Union countries, which may influence attitudes of entrepreneurs (taxpayers) in taking actions aimed at preventing food waste. This analysis demonstrates that all countries investigated in this study have made attempts to develop and implement various measures to combat the problem of food waste. At the same time, it is worth noting that properly constructed tax preferences are an important factor in preventing food waste, which is part of the sustainable development strategy implemented by European Union countries. In this respect, actions must be long-term, and they should be based on various legal measures. Further changes in this area will be determined by some key factors. These include the need to use tax law regulations or to determine economic and social trends. Directions of activities of the state, local government and non-governmental organizations for counteracting food waste will also set course for these changes. Achieving sustainable development also at the stage of using food already produced should be based on optimization of all related processes, and thus also financial (mainly tax) processes. Therefore, attention should be paid in particular to the tax legislation in force in Poland and in selected European Union countries, i.e. the Act on tax on goods and services and the Act on corporate income tax.
- ItemThe Role of the Central Bank in Foreign Exchange Inspection in Selected Countries of the European Union – as seen in the Example of Poland, the Czech Republic and Germany(Wydawnictwo KUL, 2021) Kowalewska, EwaThe activity of central banks in EU states is based on similar assumptions. Their aim is usually to maintain a stable level of prices and to support the state’s economic policy. Central banks are responsible for issuing money and for monetary policy. They have been equipped with adequate instruments to this end. The aim of this research is to demonstrate that legislation in Poland, the Czech Republic and Germany vested another important function in the central banks, namely foreign exchange inspection. However, this function is exercised differently in each of them. The central banks of countries referred to above are not only responsible for currency in circulation within the country, but also for the balance of payments. Also, by pursuing their own foreign exchange policy, they ensure an adequate position of the national currency in relation to foreign ones. The foreign exchange inspection in each of these countries is based on a different tradition and at the same time outlines the special role of the central bank. The analysis herein makes it possible to establish the scope of this inspection, taking into account the dynamics of changes that occur on the legal ground. What is also important here is whether a given country is only a member of the European Union or a member of the EU and of the euro area. The adopted research methodology is based on analysis of legislation in force with a reference to views expressed by legal commentators.
- ItemZasady i zakres wykonywania przez Narodowy Bank Polski nadzoru nad systemami płatniczymi(Wydawnictwo KUL, 2020) Kowalewska, EwaPrzedmiotem rozważań są rozwiązania prawne w odniesieniu do nadzoru systemowego w obszarze funkcjonującego w Polsce systemu płatniczego. Obowiązujące w powyższym zakresie przepisy, zarówno na poziomie krajowym, jak i unijnym, cechują się dużym rozproszeniem. Obejmują one kwestie ważne z punktu widzenia bezpieczeństwa i stabilności sektora finansowego. Celem dokonanej analizy jest pokazanie infrastruktury systemu płatniczego nadzorowanego przez Prezesa NBP oraz zwrócenie uwagi na zasady podejmowania przez bank centralny działań w omawianym zakresie. Szczególną uwagę zwrócono na Raport o nadzorze systemowym w zakresie polskiego systemu płatniczego za 2018 r., opublikowany przez NBP w grudniu 2019 r. Przyjęta w opracowaniu metodologia badań została oparta na analizie kluczowych dla tytułowego zagadnienia tekstów aktów prawnych z odniesieniem do wybranych poglądów wyrażonych w literaturze przedmiotu. Posłużono się metodą prawno-porównawczą oraz dogmatyczno-prawną. Omawiana problematyka dotyczy ważnego i stosunkowo nowego obszaru funkcjonowania banku centralnego, gdzie kluczowe cele wyznacza prawodawstwo unijne. Jednakże obszar funkcjonowania systemu płatniczego jest wyznaczony przez wewnętrzne przepisy kształtujące rynek finansowy. Zadania wypełniane w tym zakresie przez NBP determinują nowy kierunek działalności banku centralnego. Ponadto na uwagę zasługuje współpraca pomiędzy NBP a KNF. Jest to niezwykle ważne z uwagi na odpowiedzialność za utrzymanie bezpieczeństwa finansowego.
