    Data uchwalenia lex Pompeia de parricidiis

    Lex Pompeia de parricidiis was a statute related to a murderer of the closest relatives or patrons. It was likely to have been passed during one of the three Pompey the Great’s consulates in 70, 55 or 52 BC. Among those three options, the year 55 BC. seems the most probable. It was in the same year when Pompey took action to enact the law against luxury. Both lex Pompeia de parricidiis and rogatio sumptuaria could have constituted a part of Pompey’s major scheme meant to improve customs and restore a due respect to family in society.

    „Decollatio”: new materials, new perspectives

    Summary. – Times have changed. The new materials, which enrich our knowledge on the subject of the Roman decollatio, without doubt encourage us to revisit this form execution in research and analyze it anew. However, it should not be done in order to create a new ‘legal definition’. In this regard, Mommsen and his followers should be allowed to have a monopoly.

    Habilitacyjne perypetie lubelskiego historyka prawa doktora Jana Kamińskiego

    Pod koniec lat 20. XX w. Katolicki Uniwersytet Lubelski podjął starania w kierunku umożliwienia uzyskania habilitacji przez historyka prawa – doktora Jana Kamińskiego. Przedsięwzięciu temu sprzyjał prof. Przemysław Dąbkowski, który był mentorem i wychowawcą Jana Kamińskiego. Niestety, mimo wieloletnich starań, lubelskiemu uczonemu nie udało się zdobyć upragnionego tytułu. Materiały archiwalne, zachowane w zbiorach Biblioteki KUL, rzucają nowe światło na tę sprawę. Nie wszyscy byli Kamińskiemu życzliwi i nie wszyscy dotrzymali słowa, obiecawszy mu wsparcie i pomoc. At the end of the 1920s, Catholic University of Lublin made efforts to enable the habilitation of Dr Jan Kamiński, a historian of law. This undertaking was supported by prof. Przemysław Dąbkowski, who was Jan Kamiński’s mentor and tutor. Unfortunately, despite many years of efforts, the Lublin scholar did not succeed in obtaining his rightful title. Archival materials, preserved in the collection of the Library of the Catholic University of Lublin, shed new light on this case. Not everyone wished Kamiński well and not everyone kept their word, having promised him support and assistance. Наприкінці 1920-х років Люблінський католицький університет доклав зусиль, щоб історик права д-р Ян Камінський зміг отримати габілітацію. Цьому сприяв професор Пшемислав Домбковський, який був наставником і викладачем Яна Камінського. На жаль, незважаючи на багаторічні зусилля, люблінському вченому так і не вдалося здобути авторитетний титул. Архівні матеріали, що зберігаються у фондах Бібліотеки КУЛ, проливають нове світло на цю справу. Не всі були добрими до Камінського і не всі дотримали свого слова, пообіцявши йому підтримку і допомогу. В конце 1920-х гг. Люблинский католический университет предпринял усилия, чтобы историк права кандидат наук Ян Каминьски смог получить степень доктора права. Этому начинанию способствовал профессор Пшемыслав Домбковски, который был наставником и воспитателем Яна Каминьского. К сожалению, несмотря на многолетние усилия, люблинскому ученому не удалось получить положенное ему звание. Архивные материалы, хранящиеся в фондах библиотеки Люблинского католического университета, проливают новый свет на это дело. Не все были доброжелательны к Каминьскому и не все сдержали свое слово, пообещав ему поддержку и помощь.

    Imitatio et aemulatio. Kilka uwag na temat nauki i nauczania prawa rzymskiego we współczesnej Polsce

    According to numerous works, whose authors are investigating the reception of Roman law in Poland, the scope of implementing Roman law to the local legal culture has been seriously limited both by political matters and social anexieties. However, one can reach this kind of conclusion only when he accepts as a reference just the Western patterns. Obviously Poland can not be proud of glossators, commentators or any scientific movement like usus modernus pandectarum in Germany. Yet it experienced its own and particular form of reception of Roman law, which should not be considered less interesting. Unfortunately, due to the consequences of the long lasting partitions, it had not have a chance to be systemized and presented in the proper way. At the moment this task seems to be the most urgent challenge for the Polish romanists.

    In 1st and 2nd centuries A. D. Christians were occasionally persecuted and punished just for being Christians (nomen christianurn). The letter drafted by Pliny the Younger to emperor Trajan constitutes the most significant non-Christian source providing information on the procedures applied in these circumstances. Pliny mentions three groups of people that emerged due to the presented above activities: the Christians, who did not renounce their faith at court, falsely accused pagans and apostates. A governor asked those who refused to abandon their faith before executing them. The execution did not apply to Roman citizens who, according to law, were sent to Rome. Apostates and pagans underwent special tests. In order to prove that they were not Christians the governor made them call the names of gods and perform sacrifices before the image of the emperor and gods, which was followed by the course on Christ. However, it was not a refusal to participate in the rituals that led to a punishment but their attachment to Christian community. Therefore, a ceremony of purely religious nature became a real proof applied in judicial proceedings. Although the emperor expressed his approval for governor’s measures, he did not establish any general rule concerning the prosecution and punishments of Christians.

    3 maja 1944 r. Izba Reprezentantów Stanów Zjednoczonych oddała hołd twórcom polskiej konstytucji z roku 1791. Liczni przedstawiciele polskiej diaspory w Ameryce mówili o chwalebnej przeszłości Polski oraz wskazywali na niekończące się akty przemocy popełniane przez Niemców na polskiej ziemi. Stenogramy z tych obrad pokazują, że jeden głos wyraźnie różnił się od pozosta- łych. Deputowany Robert S. Hale wychwalał w swej mowie niedawne powołanie do życia Polskiego Wydziału Prawa w Oksfordzie. Jako absolwent Uniwersytetu Oksfordzkiego wyraził swój entuzjazm dla wspólnej inicjatywy uczonych i polityków. Jego przemowa przed Izbą Reprezentantów stanowi ważny ślad ilustrujący nie tylko międzynarodowe znaczenie stworzenia Polskiego Wydziału Prawa w Anglii, lecz również stosunek niektórych wpływowych amerykańskich polity.ków do sprawy polskiej
