Prowadzenie przedsiębiorstwa upadłego nie jest jakąś procedurą sądową, lecz prowadzeniem działalności gospodarczej w warunkach konkurencji i wolnego rynku. Przepisy prawa nie programują szczegółów prowadzenia przedsiębiorstwa upadłego. Również obowiązki syndyka w tym zakresie kształtowane są przy użyciu klauzul generalnych. Możliwy jest zatem swoisty spór kompetencyjny pomiędzy syndykiem upadłości a sędzią-komisarzem. W niniejszym opracowaniu broniona jest koncepcja, że syndyk korzysta, w ramach granic ustawowych, ze swoistej autonomii przy prowadzeniu przedsiębiorstwa upadłego. The study concerns the issue of the relationship between the business tasks of the trustee in running a bankrupt company and the statutory competences of the judge commisioner. Running a bankrupt enterprise is not a court procedure but a way of conducting business activity in conditions of competition and free market. The law does not specify the details of running a business but only indicates the general frameowrk of objectives for operating a bankrupt enterprise. The duties of the trustee in bankruptcy are also shaped by general clauses. Therefore, a specific competence dispute is possible between the bankruptcy trustee and the judge-commissioner.
