Ochrona danych osobowych w działalności notarialnej
Abstract
Rozprawa stanowi próbę monograficznego ujęcia problematyki prawnej ochrony danych
osobowych w działalności notarialnej. Celem naukowym rozprawy jest potrzeba znalezienia
odpowiedzi na kilka istotnych pytań teoretycznych dotyczących ochrony danych osobowych
w działalności notarialnej i tajemnicy zawodowej notariuszy, przedstawienie podstawowych
zasad służących prawidłowej interpretacji i zastosowaniu instytucji tajemnicy notarialnej oraz
ukazanie relacji norm konstytucyjnych i wzajemnych relacji norm ustawowych dotyczących
przedmiotowej problematyki. Rozdział pierwszy - Tajemnica zawodowa notariusza - konstrukcja
prawna - poświęcony został omówieniu podstawowych pojęć dotyczących tajemnicy zawodowej,
tajemnicy notarialnej jako rodzaju tajemnicy zawodowej oraz jej zakresu. Rozdział drugi -
Prawna regulacja ochrony danych osobowych. Zakres ochrony danych osobowych - służy
omówieniu zakresu przedmiotowego oraz podmiotowego ochrony danych osobowych. Rozdział
trzeci - Ochrona danych osobowych - konstrukcja prawna – podstawowe pojęcia - służy opisaniu i wyjaśnieniu istoty oraz zakresu przedmiotowego i podmiotowego danych osobowych i aspektów prawnych ich ochrony. Rozdział czwarty dotyczy przedstawienia obowiązków notariuszy w zakresie ochrony danych osobowych. W rozdziale piątym przedstawione zostały wybrane problemy dotyczące ochrony danych osobowych w działalności notarialnej.
The dissertation is an attempt to monograph the issue of the legal protection of personal data in the notarial activity. The scientific goal of the dissertation is the need to find answers to several important theoretical questions regarding the protection of personal data in the notarial activity and professional secrecy of notaries, the presentation of basic principles for correct interpretation and application of notarial secrets institutions and showing the relationship of constitutional norms and mutual relations of statutory regulations regarding the subject matter. Chapter one - Professional notary public - legal structure - is devoted to the discussion of the basic concepts of professional secrecy, notary secrecy as a kind of professional secrecy and its scope. Chapter two - Legal regulation of personal data protection. The scope of personal data protection - it is intended to discuss the scope of subject and subjective protection of personal data. Chapter three - Personal data protection - legal structure - basic concepts - serves to describe and explain the essence and scope of the personal data and legal aspects of their protection. The fourth chapter concerns the presentation of the duties of notaries in the field of personal data protection. The fifth chapter presents selected problems related to the protection of personal data in notarial activities.
